Perintah Kerja (SPK) yang meliputi Perpanjangan Waktu yaitu 1. jika terjadi
Peristiwa Kompensasi sehingga penyelesaian pekerjaan akan melampaui Tanggal
Penyelesaian maka penyedia berhak untuk meminta perpanjangan Tanggal
Penyelesaian berdasarkan data penunjang, PPK (Pejabat Pembuat Komitmen)
berdasarkan pertimbangan Pengawas Pekerjaan memperpanjang Tanggal Penyelesaian
Pekerjaan secara tertulis. Perpanjangan Tanggal Penyelesaian harus dilakukan
melalui adendum SPK (Surat Perintah Kerja) jika perpanjangan tersebut mengubah
Masa SPK (Surat Perintah Kerja) dan 2. PPK (Pejabat Pembuat Komitmen) dapat
menyetujui perpanjangan waktu pelaksanaan setelah melakukan penelitian terhadap
usulan tertulis yang diajukan oleh penyedia.

Information Sciences, the Faculty of Adab and Humanities; The Department of
Information and Library Sciences, The Faculty of Communication Sciences; and
the Department of Civil Engineering, The Faculty of Civil Engineering and
Environment of MU (Mandailing University) to update by understanding the
General Terms of Work Orders which include Extension of Time 1. if the
Compensation Event occurs so that the completion of the work will exceed the
Settlement Date the provider has the right to request extension of the
Settlement Date based on supporting data, the Commitment Making Officer based
on the Work Supervisor's consideration extends the Work Settlement Date in
writing. Extension of Settlement Date must be done through an Addendum of Work
Order if the extension changes the Period of Work Order and 2. The Commitment
Making Officer can approve the extension of the implementation time after
researching the written proposal submitted by the provider.

Perintah Kerja (SPK) yang meliputi Penghentian dan Pemutusan SPK (Surat
Perintah Kerja) yaitu 1. penghentian SPK (Surat Perintah Kerja) dapat dilakukan
karena pekerjaan sudah selesai atau terjadi Keadaan kahar; 2. dalam hal SPK
(Surat Perintah Kerja) dihentikan, maka PPK (Pejabat Pembuat Komitmen) wajib
membayar kepada penyedia sesuai dengan prestasi pekerjaan yang telah dicapai
termasuk 2.1. biaya langsung pengadaan bahan dan perlengkapan untuk pekerjaan
ini, bahan dan perlengkapan ini harus diserahkan oleh penyedia kepada PPK
(Pejabat Pembuat Komitmen), dan selanjutnya menjadi hak milik PPK (Pejabat
Pembuat Komitmen), 2.2. biaya langsung pembongkaran dan demobilisasi hasil
pekerjaan sementara dan peralatan, dan 2.3. biaya langsung demobilisasi
personil; 3. Pemutusan SPK (Surat Perintah Kerja) dapat dilakukan oleh pihak
penyedia atau pihak PPK (Pejabat Pembuat Komitmen); 4. menyimpang dari Pasal
1266 dan 1267 Kitab Undang-Undang Hukum Perdata, pemutusan SPK (Surat Perintah
Kerja) melalui pemberitahuan tertulis dapat dilakukan apabila 4.1. penyedia
lalai / cidera janji dalam melaksanakan kewajibannya dan tidak memperbaiki
kelalainnya dalam jangka waktu yang telah ditetapkan, 4.2. penyedia tanpa
persetujuan Pengawas Pekerjaan, tidak memulai pelaksanaan pekerjaan, 4.3.
penyedia menghentikan pekerjaan selama 28 (dua puluh delapan) hari dan
penghentian ini tidak tercantum dalam program
mutu serta tanpa persetujuan Pengawas Pekerjaan, 4.4. penyedia berada dalam
keadaan pailit, 4.5. penyedia selama masa SPK (Surat Perintah Kerja) gagal
memperbaiki Cacat Mutu dalam jangka waktu yang ditetapkan oleh PPK (Pejabat
Pembuat Komitmen), 4.6. denda keterlambatan pelaksanaan pekerjaan akibat
kesalahan penyedia sudah melampau 5% (lima per seratus) dari harga SPK (Surat
Perintah Kerja) dan PPK (Pejabat Pembuat Komitmen) menilai bahwa penyedia tidak
akan sanggup menyelesaikan sisa pekerjaan, 4.7. pengawas pekerjaan
memerintahkan penyedia untuk menunda pelaksanaan atau kelanjutan pekerjaan, 4.8.
PPK (Pejabat Pembuat Komitmen) tidak menerbitkan SPP (Surat Permintaan
Pembayaran) untuk pembayaran tagihan angsuran sesuai dengan angka yang
disepakati sebagaimana tercantum dalam SPK (Surat Perintah Kerja), 4.9. penyedia
terbukti melakukan KKN (Kolusi Korupsi dan Nepotisme), kecurangan dan/atau
pemalsuan dalam proses pengadaan yang diputuskan oleh instansi yang berwenang,
dan/atau 4.10. pengaduan tentang penyimpangan prosedur, dugaan KKN (Kolusi,
Korupsi, dan Nepotisme) dan/atau pelanggaran persaingan sehat dalam pelaksanaan
pengadaan dinyatakan benar oleh instansi yang berwenang; 5. dalam hal pemutusan
SPK (Surat Perintah Kerja) dilakukan karena kesalahan penyedia yaitu 5.1.
penyedia membayar denda, dan/atau 5.2. penyedia dimasukkan dalam Daftar Hitam;
dan 6. dalam hal pemutusan SPK (Surat Perintah Kerja) dilakukan karena PPK
(Pejabat Pembuat Komitmen) terlibat penyimpangan prosedur, melakukan KKN
(Kolusi, Korupsi, dan Nepotisme) dan/atau pelanggaran persaingan sehat dalam
pelaksanaan pengadaan, maka PPK (Pejabat Pembuat Komitmen) dikenakan sanksi
berdasarkan peraturan perundang-undangan.

Information Sciences, the Faculty of Adab and Humanities; The Department of
Information and Library Sciences, The Faculty of Communication Sciences; and
the Department of Civil Engineering, The Faculty of Civil Engineering and
Environment of MU (Mandailing University) to update by understanding the
General Terms of Work Orders which include Termination of Work Order namely 1.
termination of the Work Order can be done because the work is finished or there
is force majeure; 2. in the event that the Work Order is terminated, then the
Commitment Making Officer must pay the provider in accordance with the work
achievements that have been achieved including 2.1. direct costs of procuring
materials and equipment for this work, these materials and equipment must be
submitted by the provider to the Commitment Making Officer, and subsequently
become the property of the Commitment Making Officer, 2.2. direct costs of
dismantling and demobilizing the results of temporary work and equipment, and
2.3. direct costs of demobilizing personnel; 3. Termination of Work Order can
be done by the provider or the Commitment Making Officer; 4. deviates from
Article 1266 and 1267 of the Civil Code, the termination of the Work Order
through written notification can be made if 4.1. the provider fails / fails to
promise to carry out his obligations and does not improve his failure within
the stipulated period, 4.2. the provider without the approval of the Job
Supervisor, does not initiate the execution of the work, 4.3. the provider
stops work for 28 (twenty eight) days and this termination is not included in
the quality program and without the approval of the Job Supervisor, 4.4. the
provider is in bankruptcy, 4.5. the provider during the Work Order fails to
improve the Quality Disability within the period specified by the Commitment
Making Officer, 4.6. penalties for late execution of work due to provider error
have exceeded 5% (five percent) of the price of the Work Order and The
Commitment Making Official assesses that the provider will not be able to
complete the remaining work, 4.7. the job supervisor instructs the provider to
delay the execution or continuation of the work, 4.8. The Commitment Making
Official does not issue Payment Request Letter for payment of installment bills
in accordance with the agreed figures as stated in the Work Order, 4.9. the provider
is proven to conduct Collusion, Corruption and Nepotism, fraud and / or forgery
in the procurement process decided by the authorized agency, and / or 4.10.
complaints about irregularities in procedures, allegations of Collusion,
Corruption and Nepotism and / or violations of fair competition in the implementation
of procurement are declared true by the authorized agency; 5. in the case of
termination of the Work Order is carried out due to a provider error namely
5.1. the provider pays a fine, and / or 5.2. the provider is included in the
Black List; and 6. in the case of termination of the Work Order carried out
because The Commitment Making Official is involved in irregularities in
procedures, conduct Collusion, Corruption, and Nepotism and / or violation of
fair competition in the implementation of procurement, then the Commitment
Making Officer subject to sanctions based on laws and regulations.

Mandailing Raya) Pembayaran yaitu 1. pembayaran prestasi hasil pekerjaan yang
disepakati dilakukan oleh PPK (Pejabat Pembuat Komitmen), dengan ketentuan 1.1.
penyedia telah mengajukan tagihan disertai laporan kemajuan hasil pekerjaan,
1.2. pembayaran dilakukan dengan pembayaran secara sekaligus dan dapat
diberikan uang muka sebesar 30% dari nilai SPK (Surat Perintah Kerja), 1.3.
pembayaran dilakukan senilai pekerjaan yang telah terpasang, tidak termasuk
bahan/material dan peralatan yang ada
di lokasi pekerjaan, 1.4. pembayaran harus dipotong denda (apabila ada), pajak
dan uang retensi; 2. pembayaran terakhir hanya dilakukan setelah pekerjaan
selesai 100% (seratus per seratus) dan Berita Acara penyerahan pekerjaan
diterbitkan; 3. PPK (Pejabat Pembuat Komitmen) dalam kurun waktu 7 (tujuh) hari
kerja setelah pengajuan permintaan pembayaran dari penyedia harus sudah
mengajukan surat permintaan pembayaran kepada Pejabat Penandatangan Surat
Perintah Membayar (PPSPM); 4. bila terdapat ketidaksesuaian dalam perhitungan angsuran,
tidak akan menjadi alasan untuk menunda pembayaran. PPK (Pejabat Pembuat
Komitmen) meminta penyedia untuk menyampaikan perhitungan prestasi sementara
dengan mengesampingkan hal-hal yang sedang menjadi perselisihan; dan 5. apabila
dari hasil audit BPK (Badan Pemeriksa Keuangan), BPKP (Badan Pemeriksa Keuangan
dan Pembangunan), dan APIP (Aparat Pengawas Intern
Pemerintah) atau hasil temuan aparat penegak hukum terjadi kelebihan bayar maka
penyedia bertanggung jawab dan mengembalikan kelebihan bayar tersebut ke kas
negara.

recommend to the Department of Library and Information Sciences, the Faculty of
Adab and Humanities; The Department of Information and Library Sciences, The
Faculty of Communication Sciences; and the Department of Civil Engineering, The
Faculty of Civil Engineering and Environment of MU (Mandailing University) to
update by understanding the General Terms of Work Orders which include which
include Payments, namely 1. payment of agreed work results is done by The Commitment
Making Official, with provisions 1.1. the provider has submitted a bill
accompanied by a progress report on work, 1.2. payment is made by payment at
once and can be given an advance of 30% of the value of the Work Order, 1.3.
payments are made in the amount of work that has been installed, excluding equipment/materials
and equipment at the work site, 1.4. payment must be fined (if any), tax and
retention money; 2. the final payment is only made after the work is completed
100% (one hundred per hundred) and the Minutes of submission of work are
issued; 3. The Commitment Making Official within a period of 7 (seven) working
days after submitting a request for payment from the provider must have
submitted a request for payment to the Payment Order Signing Officer; 4. If
there is a discrepancy in the installment calculation, it will not be a reason
to delay payment. The Commitment Making Officer asks the provider to submit a
calculation of temporary achievements by excluding matters that are being
disputed; and 5. if from the results of the audit of the Supreme Audit Agency, The
Finance and Development Audit Agency, and Government Internal Supervisory
Apparatus or the findings of law enforcement officers, there is an overpayment,
the provider is responsible and returns the excess payment to Treasury Fund.

Perintah Kerja (SPK) yang meliputi 1. Denda, penyedia berkewajiban untuk
membayar sanksi finansial berupa Denda sebagai akibat wanprestasi atau cidera
janji terhadap kewajiban-kewajiban penyedia dalam SPK (Surat Perintah Kerja)
ini. PPK (Pejabat Pembuat Komitmen) mengenakan denda dengan memotong angsuran
pembayaran prestasi pekerjaan penyedia. Pembayaran Denda tidak mengurangi tanggung
jawab kontraktual penyedia; 2. penyelesaian perselisihan, PPK (Pejabat Pembuat
Komitmen) dan penyedia berkewajiban untuk berupaya sungguh-sungguh
menyelesaikan secara damai semua perselisihan yang timbul dari atau berhubungan
dengan SPK (Surat Perintah Kerja) ini atau interpretasinya selama atau setelah
pelaksanaan pekerjaan. Jika perselisihan tidak dapat diselesaikan secara
musyawarah maka perselisihan akan diselesaikan melalui pengadilan negeri dalam
wilayah hukum Republik Indonesia; dan 3. larangan pemberian komisi, penyedia
menjamin bahwa tidak satu pun personil satuan kerja PPK (Pejabat Pembuat
Komitmen) telah atau akan menerima komisi atau keuntungan tidak sah lainnya
baik langsung maupun tidak langsung dari SPK (Surat Perintah Kerja) ini. Penyedia
menyetujui bahwa pelanggaran syarat ini merupakan pelanggaran yang mendasar
terhadap SPK (Surat Perintah Kerja) ini.
The Coordinator of The Bureau of Cadretization, The Division
of Cadretization, Education, and Training of The Neighborhood Leadership
Assembly of The Great Mandailing Foundation to
recommend to the Department of Library and Information Sciences, the Faculty of
Adab and Humanities; The Department of Information and Library Sciences, The
Faculty of Communication Sciences; and the Department of Civil Engineering, The
Faculty of Civil Engineering and Environment of MU (Mandailing University) to
update by understanding the General Terms of Work Orders which include 1.
Fines, providers are obliged to pay financial sanctions in the form of fines
due to default or breach of contract obligations of the provider in this Work
Order. The Commitment Making Official settles fines by deducting payment for
payment of provider job performance. Payment of Fines does not reduce the
contractual responsibility of the provider; 2. settlement of disputes, the Commitment
Making Official and the provider are obliged to earnestly resolve peacefully
all disputes arising from or relating to this Work Order or its interpretation
during or after the execution of the work. If the dispute cannot be resolved by
deliberation, the dispute will be resolved through a district court within the
jurisdiction of the Republic of Indonesia; and 3. prohibition on the granting
of commissions, providers guarantee that none of work unit personnel of the Commitment
Making Officials have or will receive other illegal commissions or profits
directly or indirectly from this Work Order. The Provider agrees that this
violation of the terms is a fundamental violation of this Work Order.
