untuk memutakhirkan dengan memahami pengertian filsafat hukum, tentang arti
dari pengertian-pengertian hukum, etika dan keadilan terdapat
perbedaan-perbedaan yang jauh di antara filsuf hukum. Filsafat hukum merupakan
refleksi dari kenyataan tentang hukum. Kenyataan hukum ini oleh filsafat hukum
dipandang sebagai realisasi dari ide hukum, keputusan hukum, figur hukum, dan
lembaga hukum. Negara merupakan lembaga hukum yang terpenting sebagai gejala
historis dengan ciri-ciri tertentu, khususnya berkenaan dengan faktor kekuasaan
yang dimilikinya. Karenanya makna praktis daripada filsafat hukum saat ini
terletak dalam perlunya dikembangkan filsafat baru tentang demokrasi. Filsafat
hukum adalah suatu sistem yang ada di dalamnya semua tema dari hukum

differences between legal philosophers. Legal philosophy is a reflection of the
reality of the law. This legal reality by legal philosophy is seen as the
realization of legal ideas, legal decisions, legal figures, and legal
institutions. The state is the most important legal institution as a historical
symptom with certain characteristics, especially with regard to the power
factor it has. Therefore the practical meaning of the philosophy of law now
lies in the need to develop a new philosophy of democracy. Legal philosophy is

dari itu filsafat hukum merefleksi pertanyaan-pertanyaan yang bagi teori hukum
sama sekali tidak relevan lagi, khususnya persolan etika. Ternyata hubungan
antara hukum dan etika merupakan masalah yang terpokok dalam filsafat hukum.
Ini dikenal sebagai masalah keadilan yang sudah sejak zaman kuno
dipermasalahkan oleh sebagian besar filsuf. Baik hukum maupun etika
masing-masing memberikan kriteria tersendiri bagi penilaian atas perilaku
manusia. Dengan begitu nampak bahwa dari permasalahan ini, diskusi yang sangat
lama antara aliran di dalam filsafat hukum, khususnya aliran hukum alam dengan

the philosophy of law reflects the questions for legal theory is no longer
relevant at all, especially ethical issues. It turns out that the relationship
between law and ethics is the most basic problem in the philosophy of law. This
is known as a problem of justice that has been disputed since ancient times by
most philosophers. Both law and ethics each provide separate criteria for the
assessment of human behavior. Thus it appears that from this problem, a very
long discussion between the flow of law philosophy, especially the flow of
natural law with the flow of legal positivism is still actual to present.

hukum. Jadi filsafat hukum tidak puas dengan kesimpulan-kesimpulan dari teori
hukum. Karena itu filsafat hukum mempertanyakan 1. apakah hukum itu ?, 2.
apakah ilmu itu ?, dan 3. apakah arti

yang mewujudkan peralihan ke filsafat hukum. Teori hukum merefleksi objek dan
metode dari berbagai bentuk ilmu hukum, sehingga oleh karena itu teori hukum
dapat juga dipandang sebagai suatu jenis filsafat ilmu dari ilmu hukum. Teori
hukum modern banyak menggunakan
hasil-hasil dari filsafat ilmu modern.
Oleh karena itu terdapat kecenderungan yang kuat untuk menonjolkan pandangan
ilmu empiris. Dalam teori hukum dipermasalahkan apakah teori hukum praktis
harus dipandang sebagai ilmu empiris yang bersifat deskriptif atau tidak.
Uraian ilmu-ilmu hukum juga termasuk sebagai uraian yang bersifat teori hukum.
Dalam pada itu teori hukum juga merefleksi ciri khas dari pengembanan hukum
praktis yaitu ia mempelajari makna dan struktur dari pembentukan dan penemuan
hukum. Dengan demikian, maka teori hukum menjadi ajaran metode yuridis.

of abstraction of the legal sciences are Legal Theory, which embodies the
transition to the philosophy of law. Legal theory reflects objects and methods
from various forms of jurisprudence, so that legal theory can also be viewed as
a type of philosophy of science from law science. Modern legal theory uses
results from the philosophy of modern science. Therefore there is a strong
tendency to emphasize the view of empirical science. In legal theory it is disputed
whether practical legal theory must be viewed as an empirical science that is
descriptive or not. The description of the legal sciences is also included as a
description which is a legal theory. In the meantime, legal theory also
reflects the characteristic of practical legal development, namely that it
studies the meaning and structure of legal formation and discovery. Thus, the

untuk memutakhirkan dengan memahami pengertian filsafat hukum, ilmu-ilmu hukum
menjadi teridiri dari 1. ilmu hukum normatif, yang juga disebut sebagai ilmu
hukum praktis atau ilmu hukum dogmatis. Ilmu hukum ini adalah merupakan pengembanan hukum teoritis yang
kegiatan intelektualnya berupa memaparkan, menganalisis, mensistematisasi, dan
menginterpretasikan hukum positif yang berlaku. Dalam kenyataannya, kegiatan ini
dapat ditemukan dalam buku-buku teks, monografi, artikel, dan majalah hukum dan
khususnya dalam anotasi atas putusan hakim. Dari kegiatan ini biasanya dapat
dijumpai adanya pandangan-pandangan yang berpengaruh dalam kepustakaan hukum
yang dalam banyak hal dapat dijadikan (dipandang) sebagai sumber hukum. Ilmu
hukum semacam ini lah yang terutama diajarkan kepada para mahasiswa fakultas
hukum. Ilmu hukum praktis adalah bentuk nyata dari pengembanan hukum teoritis
yang sungguh-sungguh praktis sehingga menjadi relevan bagi pembentukan hukum
dan penemuan hukum. Tujuan yang hendak dicapainya adalah untuk memungkinkan
penerapan dan pelaksanaan hukum di dalam praktek dilaksanakan secara lebih
bertanggung jawab dan 2. ilmu hukum empiris yakni ilmu yang mempelajari hukum
sebagaimana hukum tadi nampak dalam sikap dan perilaku warga masyarakat yang
dapat diamati secara empiris. Ilmu hukum empiris teridiri dari 2.1. sejarah

of law, the legal sciences are composed of 1. normative law which is also
referred to as practical law science or dogmatic law science. This legal
science is a development of theoretical law whose intellectual activities are
describing, analyzing, systematizing, and interpreting the positive laws that
apply. In reality, this activity can be found in textbooks, monographs,
articles and legal magazines and especially in annotations on judges'
decisions. From this activity there can usually be found influential views in
the legal literature which in many ways can be used as a source of law. It is
this kind of legal science that is mainly taught to law faculty students.
Practical jurisprudence is a tangible form of the development of theoretical
law that is truly practical so that it becomes relevant for the formation of
law and legal discovery. The aim to be achieved is to enable the application
and implementation of law in practice to be carried out more responsibly and 2.
empirical legal science namely the study of law as the law appears in the
attitudes and behavior of citizens that can be observed empirically. Empirical
law consists of 2.1. legal history, 2.2. legal comparison, 2.3. legal
