Perintah Kerja (SPK) yang meliputi Waktu Penyelesaian Pekerjaan yaitu 1.
kecuali SPK (Surat Perintah Kerja) diputuskan lebih awal, penyedia berkewajiban
untuk memulai pelaksanaan pekerjaan pada Tanggal Mulai Kerja, dan melaksanakan
pekerjaan sesuai dengan program mutu,
serta menyelesaikan pekerjaan selambat-lambatnya pada Tanggal Penyelesaian yang
ditetapkan SPMK (Surat Perintah Mulai Kerja), 2. jika pekerjaan tidak selesai
pada Tanggal Penyelesaian bukan akibat Keadaan Kahar atau Peristiwa Kompensasi
atau karena kesalahan atau kelalaian penyedia maka penyedia dikenakan denda, 3.
jika keterlambatan tersebut semata-mata disebabkan oleh Peristiwa Kompensasi,
maka PPK (Pejabat Pembuat Komitmen) dikenakan kewajiban pembayaran ganti rugi.
Denda atau ganti rugi tidak dikenakan jika Tanggal Penyelesaian disepakati oleh
Para Pihak untuk diperpanjang, dan 4. Tanggal Penyelesaian yang dimaksud dalam
ketentuan ini adalah tanggal penyelesaian semua pekerjaan.
The Coordinator of The Bureau of Training, The Division of
Cadretization, Education, and Training of The Neighborhood Leadership Assembly
of The Great Mandailing Foundation to
recommend to the Department of Library and Information Sciences, the Faculty of
Adab and Humanities; The Department of Information and Library Sciences, The
Faculty of Communication Sciences; and the Department of Civil Engineering, The
Faculty of Civil Engineering and Environment of MU (Mandailing University) to
update by understanding the General Terms of Work Orders which include the Work
Settlement Time, namely 1. unless the Work Order is decided earlier, the
provider is obliged to start execution of work on the Work Start Date, and
carrying out the work in accordance with the quality program, as well as
completing the work no later than the Settlement Date specified by Starting
Work Order, 2. if the work is not completed on the Settlement Date not due to
Force Majeure or Compensation Event or due to an error or negligence of the
provider, the provider is subject to a fine, 3. if the delay is solely caused
by a Compensation Event, then the Commitment Making Officer is subject to an
obligation to pay compensation. Fines or compensation are not imposed if the
Settlement Date is agreed upon by the Parties to be extended, and 4. The
Settlement Date referred to in this provision is the date of completion of all
work.

Perintah Kerja (SPK) yang meliputi Serah Terima Pekerjaan yaitu 1. setelah
pekerjaan selesai 100% (seratus persen) sesuai dengan ketentuan yang termuat
dalam SPK (Surat Perintah Kerja), penyedia mengajukan permintaan secara
tertulis kepada PPK (Pejabat Pembuat Komitmen) untuk serah terima barang/jasa,
2. PPK (Pejabat Pembuat Komitmen) melakukan pemeriksaan terhadap barang/jasa
yang diserahkan, 3. PPK (Pejabat Pembuat Komitmen) dan penyedia menandatangani
Berita Acara Serah Terima, 4. PPK (Pejabat Pembuat Komitmen) menyerahkan
barang/jasa sebagaimana dimaksud Pasal 57 Perpres (Peraturan Presiden) Nomor 16
Tahun 2018 kepada PA/KPA (Pengguna Anggaran / Kuasa Pengguna Anggaran), 5.
PA/KPA (Pengguna Anggaran / Kuasa Pengguna Anggaran) meminta PjPHP (Pejabat
Penerima Hasil Pekerjaan) untuk melakukan pemeriksaan administratif terhadap
barang/jasa yang akan diserahterimakan, 6. hasil pemeriksaan sebagaimana
dimaksud di atas dituangkan dalam Berita Acara, 7. pembayaran dilakukan sebesar
95% (sembilan puluh lima per seratus) dari harga SPK (Surat Perintah Kerja),
sedangkan yang 05% (lima per seratus) merupakan retensi selama masa
pemeliharaan, atau pembayaran dilakukan 100% (seratus per seratus) dari harga
SPK (Surat Perintah Kerja) dan penyedia harus menyerahkan jaminan pemeliharaan
sebesar 05% (lima per seratus) dari harga SPK (Surat Perintah Kerja), 8.
penyedia wajib memelihara hasil pekerjaan setelah penyedia melaksanakan selama
masa pemeiliharaan sehingga kondisi tetap seperti pada saat penyerahan pertama
pekerjaan, 9. setelah masa pemeliharaan berakhir, penyedia mengajukan
permintaan secara tertulis kepada PPK (Pejabat Pembuat Komitmen) untuk
penyerahan akhir pekerjaan, 10. PPK (Pejabat Pembuat Komitmen) menerima
penyerahan akhir pekerjaan setelah penyedia melaksanakan semua kewajibannya
selama masa pemeliharaan dengan baik. PPK (Pejabat Pembuat Komitmen) wajib
melakukan pembayaran sisa harga SPK (Surat Perintah Kerja) yang belum dibayar
atau mengembalikan jaminan pemeliharaan, dan 11. apabila penyedia tidak
melaksanakan kewajiban pemeliharaan sebagaimana mestinya, maka PPK (Pejabat
Pembuat Komitmen) berhak menggunakan uang retensi untuk membiayai
perbaikan/pemeliharaan atau mencairkan jaminan pemeliharaan.
Personnel of The Bureau of

Neighborhood Leadership Assembly of The Great Mandailing Foundation to recommend to the Department of Library and
Information Sciences, the Faculty of Adab and Humanities; The Department of
Information and Library Sciences, The Faculty of Communication Sciences; and
the Department of Civil Engineering, The Faculty of Civil Engineering and
Environment of MU (Mandailing University) to update by understanding the
General Terms of Work Orders which include the Handover of Work, namely 1. after
the work is completed 100% (one hundred percent) in accordance with the
provisions contained in Work Order, the provider submits a request in writing
to the Commitment Making Officer for the handover of the goods / services, 2.
Commitment Making Official checks the submitted goods / services, 3. Commitment
Making Officer and the provider signs the Handover Minutes, 4. Commitment
Making Official submits the goods / services as intended in Article 57 of the
Presidential Regulation Number 16 of 2018 to Budget Users / Budget User
Proxies, 5. Budget Users / Budget User Proxies) request Employment Result Recipient
Officials to conduct administrative checks on goods / services that are will be
handed over, 6. the results of the inspection referred to above are set forth
in the Minutes, 7. payments are made in the amount of 95% (ninety-five percent)
of the price of the Work Order, while the 05% (five percent) is retention
during the maintenance period, or payment is made 100% (one hundred per
hundred) of the price of the Work Order and the provider must submit a
guarantee of maintenance amounting to 05% (five percent) of the price of the Work
Order, 8. provider has compulsory maintain the work after the provider carries
out during the maintenance period so that the conditions remain as at the time
of the first submission of work, 9. after the maintenance period ends, the
provider submits a request in writing to the Commitment Making Officer for the
final submission of work, 10. Commitment Making Officer receive final
submission of work after the provider has carried out all of his obligations
during the maintenance period. Commitment Making Official must pay the
remaining Work Order price that has not been paid or return the maintenance
guarantee, and 11. if the provider does not carry out the maintenance
obligation properly, then the Commitment Making Officer has the right to use
retention money to finance repair / maintenance or disbursement of maintenance
guarantees.

Perpustakaan dan Informasi, Fakultas Adab dan Humaniora; Jurusan Ilmu Informasi dan Perpustakaan, FIKOM (Fakultas Ilmu Komunikasi); dan Jurusan Teknik Sipil, Fakultas Teknik Sipil dan
Lingkungan UM
(Universitas Mandailing) untuk memutakhirkan dengan memahami Syarat Umum Surat
Perintah Kerja (SPK) yang meliputi Jaminan Bebas Cacat Mutu / Garansi yaitu 1.
penyedia dengan jaminan pabrikan dari produsen pabrikan (jika ada) berkewajiban
untuk menjamin bahwa selama penggunaan secara wajar oleh PPK (Pejabat Pembuat
Komitmen), Konstruksi tidak mengandung cacat mutu yang disebabkan oleh tindakan
atau kelalaian Penyedia, atau cacat mutu akibat disain, bahan, dan cara kerja,
2. jaminan bebas cacat mutu ini berlaku sampai dengan 12 (dua belas) bulan
setelah serah terima Konstruksi, 3. PPK (Pejabat Pembuat Komitmen) akan
menyampaikan pemberitahuan cacat mutu kepada Penyedia segera setelah ditemukan
cacat mutu tersebut selama Masa Layanan Purnajual, 4. terhadap pemberitahuan
cacat mutu oleh PPK (Pejabat Pembuat Komitmen), Penyedia berkewajiban
memperbaiki atau mengganti konstruksi dalam jangka waktu yang ditetapkan dalam
pemberitahuan tersebut, 5. jika penyedia tidak memperbaiki atau mengganti
Konstruksi akibat cacat mutu dalam jangka waktu yang ditentukan maka PPK
(Pejabat Pembuat Komitmen) akan menghitung biaya perbaikan yang diperlukan, dan
PPK (Pejabat Pembuat Komitmen) secara langsung atau melalui pihak ketiga yang
ditunjuk oleh PPK (Pejabat Pembuat Komitmen) akan melakukan perbaikan tersebut.
Penyedia berkewajiban untuk membayar biaya perbaikan atau penggantian tersebut
sesuai dengan klaim yang diajukan secara tertulis oleh PPK (Pejabat Pembuat
Komitmen). Biaya tersebut dapat dipotong oleh PPK (Pejabat Pembuat Komitmen)
dari nilai tagihan Penyedia, dan 6. terlepas dari kewajiban penggantian biaya, PPK
(Pejabat Pembuat Komitmen) dapat memasukkan penyedia yang lalai memperbaiki
cacat mutu ke dalam daftar hitam.
05 (five) of members of The Bureau of Education, The Division of

of The Great Mandailing Foundation to
recommend to the Department of Library and Information Sciences, the Faculty of
Adab and Humanities; The Department of Information and Library Sciences, The
Faculty of Communication Sciences; and the Department of Civil Engineering, The
Faculty of Civil Engineering and Environment of MU (Mandailing University) to
update by understanding the General Terms of Work Orders which include Quality
Defect Assurance Free / Guarantee that is 1. the provider is guaranteed by the manufacturer
(if any) to guarantee that during fair use by the Commitment Making Officer,
the Construction does not contain quality defects caused by the Provider's
actions or omissions, or quality defects due to design, materials and work
methods, 2. this quality defect free guarantee applies up to 12 (twelve) months
after the handover of Construction, 3. Commitment Making Official will deliver
the quality defect notification to the Provider immediately after the defect is
found during the After-Sales Service Period, 4. against the notice of quality
defect by The Commitment Making Officer, The Provider is obliged to improve or
replace the construction within the period specified in the giver said that, 5.
if the provider does not repair or replace the construction due to quality
defects within a specified time period then the Commitment Making Official will
calculate the required repair costs, and the Commitment Making Official
directly or through a third party appointed by The Commitment Making Official
will make these improvements. The Provider is obliged to pay the costs of
repairs or replacements in accordance with the claim submitted in writing by
the Commitment Making Official. These costs can be deducted by the Commitment
Making Officer from the Provider's invoice value, and 6. regardless of the reimbursement
obligation, the Commitment Making Officer can enter the provider who fails to
correct the quality defect in the blacklist.

covering 2.1. job changes are caused by something done by the parties in the Work
Order so that it changes the scope of work in the Work Order, 2.2. changes in
the work schedule due to changes in work, and 2.3. price changes of Work Order
due to changes in job changes and / or changes in work implementation, and 3.
for the benefit of changes to Work Order, Budget User / Budget User Proxy can
form Contract Implementing Research Officers upon the proposal of the Commitment
Making Officer.

1.5. PPK (Pejabat Pembuat Komitmen) menginstruksikan kepada pihak penyedia
untuk melakukan pengujian tambahan yang setelah dilaksanakan pengujian ternyata
tidak ditemukan kerusakan / kegagalan / penyimpangan, 1.6. PPK (Pejabat Pembuat
Komitmen) memerintahkan penundaan pelaksanaan pekerjaan, 1.7. PPK (Pejabat
Pembuat Komitmen) memerintahkan untuk mengatasi kondisi tertentu yang tidak
dapat diduga sebelumnya dan disebabkan oleh PPK (Pejabat Pembuat Komitmen), dan
1.8. ketentuan lain dalam SPK (Surat Perintah Kerja), 2. jika peristiwa
kompensasi mengakibatkan pengeluaran tambahan dan/atau keterlambatan
penyelesaian pekerjaan maka PPK (Pejabat Pembuat Komitmen) berkewajiban untuk
membayar ganti rugi dan/atau memberikan perpanjangan waktu penyelesaian
pekerjaan, 3. ganti rugi hanya dapat dibayarkan jika berdasarkan data penunjang
dan perhitungan kompensasi yang diajukan oleh penyedia kepada PPK (Pejabat
Pembuat Komitmen), dapat dibuktikan kerugian nyata akibat peristiwa kompensasi,
4. perpanjangan waktu penyelesaian pekerjaan hanya dapat diberikan jika
berdasarkan data penunjang dan perhitungan kompensasi yang diajukan oleh
penyedia kepada PPK (Pejabat Pembuat Komitmen), dapat dibuktikan perlunya
tambahan waktu akibat peristiwa kompensasi, dan 5. penyedia tidak berhak atas
ganti rugi dan/atau perpanjangan waktu penyelesaian pekerjaan jika penyedia
gagal dan lalai untuk memberikan peringatan dini dalam mengantisipasi dampak
Peristiwa Kompensasi.

Events namely 1. compensation events can be given to providers in the following
matters 1.1. The Commitment Making Officer changes the schedule that can affect
the execution of the work, 1.2. late payment to provider, 1.3. The Commitment
Making Official does not provide pictures, specifications and / or instructions
according to the required schedule, 1.4. the provider cannot enter the location
according to schedule, 1.5. The Commitment Making Officer) instructs the provider
to carry out additional testing which after testing has found no damage /
failure / deviation, 1.6. The Commitment Making Official ordered a delay in the
execution of work, 1.7. The Commitment Making Official orders to overcome
