untuk memutakhirkan dengan memahami pengertian filsafat hukum, pengembanan
hukum teoritis juga sebagai refleksi teoritis tentang hukum yaitu sebagai
kegiatan akal budi untuk mendapatkan penguasaan intelektual tentang hukum atau
pemahaman secara ilmiah atas hukum, yaitu secara metodis sistematis – logis
rasional. Pengembanan hukum teoritis dibedakan dalam 3 (tiga) jenis berdasarkan
tingkat abstraksinya atau berdasarkan
tataran analisisnya (level of analysis)
yaitu ilmu-ilmu hukum, teori hukum dan filsafat hukum. Pada tataran yang lebih
rendah tingkat abstraksinya pengembanan hukum teoritis disebut ilmu-ilmu hukum.
Oleh ilmu-ilmu hukum ini, hukum secara ilmiah dipelajari dari berbagai sudut
pandangan karena hukum adalah merupakan gejala kemasyarakatan yang memiliki

intellectual mastery of law or scientific understanding of the law, which is systematic
methodically - logically rational. Theoretical legal development is divided into
3 (three) types based on the level of abstraction or based on the level of
analysis, namely the legal sciences, legal theory and legal philosophy. At a
lower level the level of abstraction carry on theoretical law is called the
legal sciences. By these legal sciences, law is scientifically studied from
various points of view because law is a symptom of society that has broad and

a matter of providing legal services organized by certain legal experts in
problematic situations and / or conflict situations, dealt with by the
application of legal rules with / or without utilizing juridical procedures [Schuit,
{CS (Cum Suis = And Friends) Latin Language}, Path to the Right or Path of
Truth (De Weg naar het Rechts), 1976: 62].
Dengan begitu bantuan hukum adalah tindakan secara nyata dalam
mendampingi orang-orang yang terlibat dalam kesulitan hukum. Mereka melakukan
bantuan hukum ini biasa dikenal dengan advokat, Biro Bantuan Hukum, Lembaga
Bantuan Hukum yang diselenggarakan oleh mahasiswa fakultas hukum. Bantuan hukum
sangat diperlukan karena hukum modern
yang terdiri atas sejumlah aturan selain pertambahannya terus meningkat, juga
memperlihatkan struktur yang rumit.
Thus legal
assistance is a real action in assisting people involved in legal difficulties.
They are doing legal assistance, commonly known as advocates, Legal Aid Bureau,
Legal Aid Institutions, organized by law faculty students. Legal assistance is
very necessary because modern law which consists of a number of rules other
than the increase continues to increase, also shows a complex structure.
Pada pemberian bantuan hukum dalam kejadian-kejadian yang tidak dilakukan
proses hukum, maka bantuan hukum adalah mirip dengan pekerjaan sosial atau
bantuan hukum terapeutik. Akan tetapi aksennya tetap pada penerapan hukum.
Keadaan ini memperlihatkan bahwa permasalahan filsafat hukum dan bantuan hukum
pada hakikatnya adalah tidak berbeda dari permasalahan filsafat hukum pada
pembentukan hukum dan penemuan hukum. Sedangkan perbedaannya terletak pada
sifat praktisnya dan tidak pada struktur teoritisnya. (Rasjidi, Uli, Prof., DR., SH, Drs., LLM,

In the provision of

of concrete juridical decision-making activities that directly cause legal
consequences for an individual (judge's decisions, provisions, establishment of
notary deeds, etc.).
Pada dasarnya penemuan hukum itu adalah pencerminan pembentukan hukum.
Dalam pembentukan hukum yang terjadi adalah menetapkan hal-hal yang umum yang
daripdanya dapat dijabarkan hal-hal yang khusus, maka penemuan hukum adalah
kebalikannya. Dalam penemuan hukum hal-hal yang khususlah yang dimunculkan dan
pada saat yang sama daripadanya dikonsultasikan dampak keberlakuan secara umum.

Basically, the
discovery of the law is a reflection of the formation of law. In the legal
formation that occurs is to determine the general matters from which can be

berwenang atau organ-organ pusat pemerintahan berdasarkan konstitusi, contoh,
tindakan Presiden Sukarno tahun 1945 mengangkat
Sutan Syahrir sebagai Perdana Menteri yang bertanggung jawab kepada KNIP
(Komite Nasional Indonesia Pusat) yang menjalankan fungsi DPR (Dewan Perwakilan
Rakyat) dan dengan tindakan itu mengubah sistem pemerintahan presidensial
menjadi sistem pemerintahan parlementer tanpa mengubah konstitusi (UUD 1945,
Undang-Undang Dasar Tahun 1945). Kegiatan perumusan peraturan-peraturan umum
yang dikenal sebagai kegiatan perundang-undangan adalah merupakan kegiatan
pembentukan hukum yang terpenting dan paling modern. Di sini diciptakan suatu model perilaku abstrak, yang kelak dapat digunakan untuk

general, these activities are related to / or can result from 1. the
formulation of general regulations that can be in the form of additions or
changes to existing regulations, 2. concrete decisions (precedents legal or
jurisprudence), and 3. actions the real thing that is done by the authorities
or the central organs of government based on the constitution, for example, the
actions of President Sukarno in 1945 appointed Sutan Syahrir as the Prime
