PEDOMAN PELAKSANAAN PENYUSUNAN, EVALUASI, DAN PERSETUJUAN DOKUMEN LAPORAN STUDI KELAYAKAN IZIN USAHA PERTAMBANGAN KOMODITAS BATUAN DENGAN LUASAN PALING LUAS 50 (LIMA PULUH) HEKTAR DAN DOKUMEN RENCANA PENAMBANGAN SURAT IZIN PENAMBANGAN BATUAN

CONCERNING GUIDELINES FOR THE IMPLEMENTATION OF THE PREPARATION, EVALUATION, AND APPROVAL OF THE FEASIBILITY STUDY REPORT DOCUMENT FOR MINING BUSINESS PERMITS FOR ROCK COMMODITIES WITH A MAXIMUM AREA OF 50 (FIFTY) HECTARES AND THE MINING PLAN DOCUMENT OF ROCK MINING PERMITS

 

DIREKTUR JENDERAL MINERAL DAN BATUBARA KEMENTERIAN ENERGI DAN SUMBER DAYA MINERAL,

DIRECTOR GENERAL OF MINERALS AND COAL, MINISTRY OF ENERGY AND MINERAL RESOURCES,

 

Menimbang : a. bahwa dalam rangka percepatan dan penyederhanaan dalam pemberian pedoman pelaksanaan dalam penyusunan, evaluasi dan persetujuan dokumen studi kelayakan Izin Usaha Pertambangan (IUP) komoditas batuan dengan luasan paling luas 50 (lima puluh) hektar, perlu menyederhanakan substansi Keputusan Menteri Energi dan Sumber Daya Mineral Nomor 1806 K/30/MEM/ 2018 tentang Pedoman Pelaksanaan Penyusunan, Evaluasi, Persetujuan Rencana Kerja dan Anggaran Biaya, serta Laporan Pada Kegiatan Usaha Pertambangan Mineral dan Batubara terkait pemberian pedoman pelaksanaan dalam penyusunan, evaluasi dan persetujuan dokumen studi kelayakan;

b. bahwa setelah terbitnya Undang-Undang Nomor 3 Tahun 2020 tentang Perubahan atas Undang-Undang Nomor 4 Tahun 2009 tentang Pertambangan Mineral dan Batubara serta terbitnya Peraturan Pemerintah Nomor 96 Tahun 2021 tentang Pelaksanaan Kegiatan Usaha Pertambangan Mineral dan Batubara yang mengatur nomenklatur perizinan baru Surat Izin Penambangan Batuan (SIPB), perlu untuk dibuat pedoman pelaksanaan dalam penyusunan, evaluasi dan persetujuan dokumen rencana penambangan SIPB;

c. bahwa berdasarkan pertimbangan sebagaimana dimaksud dalam huruf a dan huruf b, perlu menetapkan Keputusan Direktur Jenderal Mineral dan Batubara tentang Pedoman Pelaksanaan Penyusunan, Evaluasi, dan Persetujuan Dokumen Laporan Studi Kelayakan Izin Usaha Pertambangan Komoditas Batuan Dengan Luasan Paling Luas 50 (lima puluh) Hektar dan Dokumen Rencana Penambangan Surat Izin Penambangan Batuan;

Considering:   a.  that in order to accelerate and simplify the provision of implementation guidelines for the preparation, evaluation, and approval of feasibility study documents for Mining Business Permits (IUP) for rock commodities with a maximum area of ​​50 (fifty) hectares, it is necessary to simplify the substance of Decree of the Minister of Energy and Mineral Resources Number 1806 K/30/MEM/2018 concerning Guidelines for the Preparation, Evaluation, and Approval of Work Plans and Budgets, as well as Reports on Mineral and Coal Mining Business Activities regarding the provision of implementation guidelines for the preparation, evaluation, and approval of feasibility study documents;

b. that following the issuance of Law Number 3 of 2020 concerning Amendments to Law Number 4 of 2009 concerning Mineral and Coal Mining and the issuance of Government Regulation Number 96 of 2021 concerning the Implementation of Mineral and Coal Mining Business Activities, which regulates the new permit nomenclature for Rock Mining Permits (SIPB), it is necessary to establish implementation guidelines for the preparation, evaluation, and approval of mining plan documents for Rock Mining Permits;

c. that based on the considerations referred to in letters a and b, it is necessary to stipulate a Decree of the Director General of Minerals and Coal concerning Implementation Guidelines for the Preparation, Evaluation, and Approval of Feasibility Study Report Documents for Rock Commodity Mining Business Permits with a Maximum Area of ​​50 (fifty) Hectares and Mining Plan Documents for Rock Mining Permits;
