POST-MINING SUCCESS IN MINERAL AND COAL MINING BUSINESS ACTIVITIES
A. PENDAHULUAN (halaman 88)
Berdasarkan
ketentuan Pasal 33 dan Pasal 39 Peraturan Pemerintah Nomor 78 Tahun 2010
tentang Reklamasi dan Pascatambang, Menteri atau gubernur sesuai dengan
kewenangannya dapat menetapkan pihak ketiga untuk melaksanakan sebagian atau
seluruh kegiatan Reklamasi dan Pascatambang dengan menggunakan jaminan
Reklamasi atau Pascatambang apabila pemegang IUP atau pemegang IUPK tidak
berhasil memenuhi kriteria keberhasilan sesuai dengan rencana Reklamasi atau
Pascatambang yang telah disetujui.
A. INTRODUCTION

Based on the provisions of Article 33 and
Article 39 of Government Regulation Number 78 of 2010 concerning Reclamation
and Post-Mining, the Minister or governor, in accordance with their authority,
may appoint a third party to carry out some or all of the Reclamation and
Post-Mining activities using Reclamation or Post-Mining guarantees if the
holder of a Mining Business Permit or holder of a Special Mining Business
Permit fails to meet the success criteria in accordance with the approved
Reclamation or Post-Mining plan.
Selain
pihak ketiga dalam rangka pelaksanaan kegiatan Reklamasi dan Pascatabambang di
atas, untuk mewujudkan efektivitas dan akuntabilitas dalam penilaian
keberhasilan kegiatan Reklamasi atau Pascatambang, diperlukan penetapan pihak
ketiga sebagai pelaksana penilaian capaian keberhasilan Reklamasi atau
Pascatambang secara obyektif dan independen.
In addition to third
parties in the implementation of the Reclamation and Post-mining activities
above, to realize effectiveness and accountability in assessing the success of
Reclamation or Post-mining activities, it is necessary to appoint a third party
