APPOINTMENT OF THIRD PARTIES AS IMPLEMENTERS OF RECLAMATION AND/OR
POST-MINING
AND
THIRD PARTIES AS ASSESSORS OF RECLAMATION AND/OR
POST-MINING SUCCESS IN MINERAL AND COAL MINING BUSINESS ACTIVITIES
C. KETENTUAN DALAM PENETAPAN PIHAK KETIGA SEBAGAI PELAKSANA
REKLAMASI DAN/ATAU PASCATAMBANG
1. Alur pengusulan dan penetapan
e. Direktur Jenderal atau gubernur sesuai dengan
kewenangannya, berdasarkan evaluasi laporan dan penilaian lapangan menetapkan
pihak ketiga sebagaimana dimaksud pada huruf c;
f. Dalam hal pemegang IUP tahap kegiatan Eksplorasi, pemegang
IUP tahap kegiatan Operasi Produksi, pemegang IUPK tahap kegiatan Eksplorasi,
atau pemegang IUPK tahap kegiatan Operasi Produksi tidak mengusulkan pihak
ketiga, Direktur Jenderal atau gubernur sesuai dengan kewenangannya menunjuk
dan menetapkan pihak ketiga untuk melaksanakan Reklamasi dan/atau Pascatambang;
g. Pengusulan pihak ketiga sebagaimana dimaksud pada huruf a
dan huruf c dilakukan dengan ketentuan:
1) Pihak ketiga yang diusulkan harus memenuhi syarat sebagai
pihak ketiga;
2) Pemegang IUP tahap kegiatan Eksplorasi, pemegang IUP tahap
kegiatan Operasi Produksi, pemegang IUPK tahap kegiatan Eksplorasi, dan
pemegang IUPK tahap kegiatan Operasi Produksi, terlebih dahulu melakukan
evaluasi terhadap pihak ketiga yang diusulkan;
3) hasil evaluasi sebagaimana dimaksud pada angka 2) dan
pernyataan kelayakan atas pihak ketiga disampaikan kepada Direktur Jenderal
atau gubernur sesuai dengan kewenangannya; dan
4) Surat penetapan pihak ketiga oleh Direktur Jenderal atau
gubernur ditembuskan kepada para pemangku kepentingan.
C. PROVISIONS FOR
DETERMINING THIRD PARTIES AS IMPLEMENTERS OF RECLAMATION AND/OR POST-MINING
1. Proposal and
Determination Process
e. The Director General
or the governor, in accordance with their authority, shall appoint the third
party as referred to in letter c based on the evaluation of reports and field
assessments;
f. If the holder of a
Mining Business Permit at the Exploration stage, the holder of a Mining
Business Permit at the Production Operation stage, the holder of a Special
Mining Business Permit at the Exploration stage, or the holder of a Special
Mining Business Permit at the Production Operation stage does not propose a
third party, the Director General or the governor, in accordance with their
authority, shall appoint and appoint the third party to implement Reclamation
and/or Post-mining;
g. The proposal of a
third party as referred to in letters a and c shall be carried out under the
following conditions:
1) The proposed third
party must meet the requirements as a third party;
2) Holders of Mining
Business Permits in the Exploration phase, holders of Mining Business Permits
in the Production Operation phase, holders of Special Mining Business Permits
in the Exploration phase, and holders of Special Mining Business Permits in the
Production Operation phase must first evaluate the proposed third party;
3) The evaluation
results as referred to in number 2) and the statement of eligibility for the
third party are submitted to the Director General or the governor, in
accordance with their authority; and
4) The letter of
determination of the third party by the Director General or the governor is
copied to the stakeholders.
