THIRD PARTIES AS IMPLEMENTERS OF RECLAMATION AND/OR
POST-MINING
AND
THIRD PARTIES AS ASSESSORS OF RECLAMATION AND/OR POST-MINING SUCCESS IN
MINERAL AND COAL MINING BUSINESS ACTIVITIES
C. KETENTUAN DALAM PENETAPAN PIHAK KETIGA SEBAGAI PELAKSANA
REKLAMASI DAN/ATAU PASCATAMBANG
4. Tata Laksana Mekanisme pelaksanaan kegiatan Reklamasi
dan/atau Pascatambang oleh pihak ketiga dilakukan sebagai berikut:
c. Pelaporan dan Pencairan Jaminan Reklamasi dan/atau Jaminan
Pascatambang
1) Mekanisme pelaporan dan penilaian kegiatan Reklamasi
dan/atau Pascatambang oleh pihak ketiga mengacu pada Lampiran I;
2) Pemegang IUP tahap kegiatan Eksplorasi, pemegang IUP tahap
kegiatan Operasi Produksi atau pemegang IUPK tahap kegiatan Operasi Produksi
yang tidak dalam kondisi pailit, mekanisme pencairan Reklamasi dan/atau
Pascatambang dilaksanakan sesuai Lampiran I;
3) Dalam hal pemegang IUP tahap kegiatan Eksplorasi, pemegang
IUPK tahap kegiatan Eksplorasi, pemegang IUP tahap kegiatan Operasi Produksi,
atau pemegang IUPK tahap kegiatan Operasi Produksi dinyatakan pailit oleh
pengadilan, mekanisme pencairan Reklamasi dan/atau Pascatambang dapat
dilaksanakan secara bertahap sesuai dengan pencapaian keberhasilan Reklamasi
dan/atau Pascatambang; dan
4) Dalam hal tidak dalam kondisi pailit dan pemegang IUP
tahap kegiatan Eksplorasi, pemegang IUPK tahap kegiatan Eksplorasi, pemegang
IUP tahap kegiatan Operasi Produksi, atau pemegang IUPK tahap kegiatan Operasi
Produksi ingin mencairkan Jaminan Reklamasi dan/atau Jaminan Pascatambang maka
pemegang IUP tahap kegiatan Eksplorasi, pemegang IUPK tahap kegiatan
Eksplorasi, pemegang IUP tahap kegiatan Operasi Produksi, atau pemegang IUPK
tahap kegiatan Operasi Produksi dapat mengajukan permohonan pertimbangan
pencairan kepada Direktur Jenderal.
C. PROVISIONS FOR
DETERMINING THIRD PARTIES AS IMPLEMENTERS OF RECLAMATION AND/OR POST-MINING
4. Procedures The
mechanism for implementing Reclamation and/or Post-Mining activities by third
parties is as follows:
c. Reporting and
Disbursement of Reclamation and/or Post-Mining Guarantees
1) The reporting and
assessment mechanism for Reclamation and/or Post-Mining activities by third
parties refers to Appendix I;
2) For holders of
Mining Business Permits in the Exploration phase, holders of Mining Business
Permits in the Production Operation phase, or holders of Special Mining
Business Permits in the Production Operation phase who are not bankrupt, the
disbursement mechanism for Reclamation and/or Post-Mining funds is implemented
in accordance with Appendix I;
3) In the event that
the holder of a Mining Business Permit at the Exploration stage, the holder of
a Special Mining Business Permit at the Exploration stage, the holder of a
Mining Business Permit at the Production Operation stage, or the holder of a
Special Mining Business Permit at the Production Operation stage is declared
bankrupt by the court, the mechanism for disbursing Reclamation and/or
Post-Mining funds can be implemented in stages in accordance with the
achievement of success in Reclamation and/or Post-Mining; and
4) In the event that
the holder of a Mining Business Permit in the Exploration stage, a Special
Mining Business Permit in the Exploration stage, a Mining Business Permit in
the Production Operation stage, or a Special Mining Business Permit in the
Production Operation stage wishes to liquidate the Reclamation Guarantee and/or
Post-Mining Guarantee, the holder of the Mining Business Permit in the Exploration
stage, the holder of the Special Mining Business Permit in the Exploration
stage, the holder of the Mining Business Permit in the Production Operation
stage, or the holder of the Special Mining Business Permit in the Production
Operation stage may submit a request for consideration of liquidation to the
Director General.
