Dalam segenap undang-undang, peraturan-peraturan dan
ketentuan-ketentuan di mana tercantum kata atas nama :

Agar supaya setiap orang dapat mengetahuinya, memerintahkan pengundangan
undang-undang ini dengan penempatan dalam Lembaran-Negara Republik Indonesia.

OF UNIVERSITEIT, UNIVERSITET AND UNIVERSITIT, FACULTEIT, FACULTET AND FACULTIT
TO BE UNIVERSITAS AND FAKULTAS.
Sebelum ada undang-undang ini maka tidak ada istilah dan
nama badan yang seragam dalam Bahasa Indonesia guna mengganti istilah dan nama
"Universiteit" dan "Faculteit", sehingga di Indonesia
terdapat tiga buah universitas negeri dengan nama,

1. Unversitet Indonesia (di Jawa-Barat),

3. Universitas Airlangga (di Jawa-Timur),

Indonesia (in West Java),
2. State Universitit
of Gadjah Mada (in Central Java),
3. Universitas Airlangga (in East Java),
3. Universitas Airlangga (in East Java),
yang berturut-turut terjadi atas beberapa Fakultet, Fakultit
dan Fakultas. Ditinjau dari sudut kesatuan dan ilmu bahasa hal ini tidak dapat
dibiarkan lebih lama lagi dan perlu ditetapkan suatu nama dan istilah yang sama
untuk semua perguruan tinggi negeri di Indonesia. Kekacauan dalam nama haruslah
dihilangkan dengan memakai istilah yang seragam. Bahwa istilah dan nama
Universitas dan Fakultas ialah istilah yang dipandang tepat dan sebaik-baiknya
untuk mencapai keseragaman istilah, dan berasal dari kata-kata Latin. Dengan
undang-undang ini ditetapkan pula, bahwa Universiteit van Indonesie dan
Universitit Negeri Gajah Mada diubah namanya dalam bahasa Indonesia menjadi Universitas
Indonesia dan Universitas Gajah Mada, yang terjadi atas beberapa Fakultas.
Selanjutnya bagi segala peraturan dan ketentuan istilah dan nama resmi untuk
mengganti kata "universiteit" dan "faculteit" ialah
"universitas" dan "fakultas".

KETENTUAN UMUM

Pasal 1
Dalam Peraturan Pemerintah ini yang dimaksud dengan:

belajar adalah program pendidikan minimal yang harus diikuti oleh warga negara
Indonesia atas tanggung jawab Pemerintah dan pemerintah daerah.

berbentuk Sekolah Dasar (SD) dan Madrasah Ibtidaiyah (MI) atau bentuk lain yang

3. Sekolah
Dasar yang selanjutnya disebut SD adalah salah satu bentuk satuan pendidikan formal yang menyelenggarakan pendidikan
umum pada jenjang pendidikan dasar.
4. Madrasah
Ibtidaiyah yang selanjutnya disebut MI adalah salah satu bentuk satuan
pendidikan formal yang menyelenggarakan pendidikan umum dengan kekhasan agama
Islam pada jenjang pendidikan dasar, di dalam pembinaan Menteri Agama.
5. Sekolah
Menengah Pertama yang selanjutnya disebut SMP adalah salah satu bentuk satuan
pendidikan formal yang menyelenggarakan pendidikan umum pada jenjang pendidikan
dasar sebagai lanjutan dari SD, MI, atau bentuk lain yang sederajat.
6. Madrasah
Tsanawiyah yang selanjutnya disebut MTs adalah salah satu bentuk satuan
pendidikan formal yang menyelenggarakan pendidikan umum dengan kekhasan agama
Islam pada jenjang pendidikan dasar sebagai lanjutan dari SD, MI, atau bentuk
lain yang sederajat, di dalam pembinaan Menteri Agama.
7. Program
paket A adalah program pendidikan dasar jalur nonformal yang setara SD.
8. Program
paket B adalah program pendidikan dasar jalur nonformal yang setara SMP.
9. Pemerintah
adalah Pemerintah pusat.
10.
Pemerintah daerah adalah pemerintah provinsi, pemerintah kabupaten, atau
pemerintah kota.
11. Menteri
adalah menteri yang menangani urusan pemerintahan di bidang pendidikan
nasional.

FUNCTION AND OBJECTIVES
Pasal 2
(1) Wajib
belajar berfungsi mengupayakan perluasan dan pemerataan kesempatan memperoleh
pendidikan yang bermutu bagi setiap warga negara Indonesia.
(2) Wajib
belajar bertujuan memberikan pendidikan minimal bagi warga negara Indonesia
untuk dapat mengembangkan potensi dirinya agar dapat hidup mandiri di dalam
masyarakat atau melanjutkan pendidikan ke jenjang yang lebih tinggi.

Indonesian citizen.
(2) Compulsory education aims to provide minimal education for Indonesian citizens to be able to develop their potential in order to live independently in the community or continue education to a higher level.

PENYELENGGARAAN

IMPLEMENTATION
Pasal 3
(1) Wajib belajar
diselenggarakan pada jalur pendidikan formal,
pendidikan nonformal, dan pendidikan informal.
(2)
Penyelenggaraan wajib belajar pada jalur formal
dilaksanakan minimal pada jenjang
pendidikan dasar yang meliputi SD, MI, SMP, MTs, dan bentuk lain yang
sederajat.
(3)
Penyelenggaraan wajib belajar pada jalur pendidikan nonformal dilaksanakan melalui program paket A, program paket B,
dan bentuk lain yang sederajat.
(4)
Penyelenggaraan wajib belajar pada jalur pendidikan informal dilaksanakan
melalui pendidikan keluarga dan/atau pendidikan lingkungan.
(5) Ketentuan
mengenai penyetaraan pendidikan nonformal
dan pengakuan hasil pendidikan informal
penyelenggara program wajib belajar terhadap pendidikan dasar jalur formal diatur dalam peraturan
perundang-undangan yang mengatur tentang penyelenggaraan dan pengelolaan
pendidikan.
Article 3
(1) Compulsory education is conducted on
formal education, non formal education, and informal education.
(2) The implementation of compulsory
education on formal channels shall be carried out at least at the level of
primary education covering SD, MI, SMP, MTs, (in Bahasa) and other equivalent
forms.
(3) The implementation of compulsory
education on non-formal education channels is implemented through package A,
package B program, and other equivalent forms.
(4) Implementation of compulsory education
on informal education channels is implemented through family education and / or
environmental education.
(5) Provisions on the equalization of non-formal education and the recognition of informal educational outcomes of the compulsory education program providers of basic formal education shall be regulated in laws and regulations governing the administration and management of education.

Pasal 4
Program wajib belajar diselenggarakan oleh Pemerintah,
pemerintah daerah sesuai kewenangannya, atau masyarakat.
Article 4
The compulsory
education program is administered by the Government, local government according
to its authority, or the community.
Pasal 5
(1) Satuan
pendidikan dasar penyelenggara program wajib belajar wajib menjaga
keberlangsungan pelaksanaan program wajib belajar yang bermutu dan memenuhi
Standar Nasional Pendidikan.
(2) Satuan
pendidikan dasar penyelenggara program wajib belajar wajib menerima peserta
didik program wajib belajar dari lingkungan sekitarnya tanpa diskriminasi
sesuai daya tampung satuan pendidikan yang bersangkutan.
(3)
Penerimaan peserta didik sebagaimana dimaksud pada ayat (2) pada SD/MI atau
yang sederajat tidak mempersyaratkan bahwa calon peserta didik yang bersangkutan
telah menyelesaikan pendidikan anak usia dini.
(4) Satuan
pendidikan dasar penyelenggara program wajib belajar yang melanggar ketentuan
sebagaimana dimaksud pada ayat (2) dikenakan sanksi administrasi berupa
teguran, penghentian pemberian bantuan hingga penutupan satuan pendidikan yang
bersangkutan.
Article 5
(1) The basic education unit of
compulsory education program organizer must maintain the continuity of the
implementation of compulsory education program and meet the National Education Standards.
(2) The basic education unit of
compulsory education program organizer shall be obliged to accept learners of
compulsory education program from the surrounding environment without
discrimination according to the capacity of the unit of education concerned.
(3) The acceptance of students as
referred to in paragraph (2) in SD / MI or equivalent does not require that the
applicant concerned has completed the education of the early child.
(4) The basic education unit of
the compulsory education program organizer violating the provisions referred to
in paragraph (2) shall be liable to administrative sanctions in the form of
reprimands, termination of assistance until closure of the educational unit
concerned.

PENGELOLAAN
CHAPTER IV
MANAGEMENT
Pasal 6
(1)
Pengelolaan program wajib belajar secara nasional menjadi tanggung jawab
Menteri.
(2)
Koordinasi pengelolaan program wajib belajar pendidikan dasar tingkat provinsi
menjadi tanggung jawab gubernur.
(3)
Pengelolaan program wajib belajar pendidikan dasar tingkat kabupaten/kota
menjadi tanggung jawab bupati/walikota.
(4)
Pengelolaan program wajib belajar pada tingkat satuan pendidikan dasar menjadi
tanggung jawab pemimpin satuan pendidikan dasar.
(5) Pengelolaan
program wajib belajar pendidikan dasar di luar negeri menjadi tanggung jawab
Kepala Perwakilan Negara Kesatuan Republik Indonesia di luar negeri yang
bersangkutan.
Article 6
(1) The management of the national education

education program of provincial level elementary education shall be the
responsibility of the governor.
(3) The management of compulsory education
program at the district / municipality level is the responsibility of the
regent / mayor.
(4) The management of compulsory education
programs at the elementary level of education shall be the responsibility of
the leader of the elementary education unit.
(5) The management of elementary compulsory education program overseas shall be the responsibility of the Head of Representative of the Unitary State of the Republic of Indonesia abroad concerned.

Pasal 7
(1)
Pemerintah menetapkan kebijakan nasional pelaksanaan program wajib belajar yang
dicantumkan dalam Rencana Kerja Pemerintah, Anggaran Pendapatan dan Belanja
Negara, Rencana Strategis Bidang Pendidikan, Rencana Pembangunan Jangka
Menengah, dan Rencana Pembangunan Jangka Panjang.
(2)
Pemerintah dan pemerintah daerah sesuai kewenangannya berkewajiban
menyelenggarakan program wajib
belajar berdasarkan kebijakan nasional sebagaimana dimaksud pada ayat (1).
(3)
Penyelenggaraan program wajib belajar
oleh pemerintah daerah sebagaimana dimaksud pada ayat (2) ditetapkan dalam
Rencana Kerja Pemerintah Daerah, Anggaran Pendapatan dan Belanja Daerah,
Rencana Strategis Daerah Bidang Pendidikan, Rencana Pembangunan Jangka Menengah
Daerah, dan Rencana Pembangunan Jangka Panjang Daerah.
(4)
Pemerintah daerah dapat menetapkan kebijakan untuk meningkatkan jenjang
pendidikan wajib belajar sampai pendidikan menengah.
(5)
Pemerintah daerah dapat mengatur lebih lanjut pelaksanaan program wajib
belajar, sesuai dengan kondisi daerah masingmasing melalui Peraturan Daerah.
(6) Ketentuan
mengenai pelaksanaan program wajib belajar yang diatur oleh pemerintah daerah
sebagaimana dimaksud pada ayat (5) termasuk kewenangan memberikan sanksi
administratif kepada warga negara Indonesia yang memiliki anak berusia 7
(tujuh) sampai dengan 15 (lima belas) tahun yang tidak mengikuti program wajib
belajar.
Article 7
(1) The
Government shall establish the national policies for the implementation of
compulsory education programs as set forth in the Government Work Plan, the
State Budget, the Education Strategic Plan, the Medium-Term Development Plan,
and the Long-Term Development Plan.
(2) The
Government and regional governments in accordance with their respective powers
shall be obligated to undertake compulsory education programs pursuant to the
national policy referred to in paragraph (1).
(3) The
implementation of compulsory education programs by regional governments as
referred to in paragraph (2) shall be stipulated in the Regional Government
Work Plan, Regional Income and Expenditure Budget, Regional Strategic Plan for
Education, Medium Term Development Plan, and Regional Long Term Development
Plan.
(4) Local
governments may set policies to increase the level of compulsory education
through secondary education.
(5) The
regional government may further regulate the implementation of compulsory
education programs, in accordance with the conditions of their respective
regions through regional regulations.
(6)
Provisions concerning the implementation of compulsory education programs
regulated by regional governments as referred to in paragraph (5) shall include
the authority to impose administrative sanctions to Indonesian nationals having
children aged 7 (seven) to 15 (fifteen) years who do not participate in the
program of compulsory education.
