mendasar antara Peraturan Presiden (Perpres) Nomor 54 Tahun 2010 dan
Perubahannya dengan Peraturan Presiden (Perpres) Nomor 16 Tahun 2018 dimana
dari pengertian ini, dapat dilihat ada perbedaan pada 3 (tiga) titik yaitu 1. K
/ L / D / I menjadi K / L / PD, latar belakang perubahan ini adalah penyesuaian
dengan Peraturan Presiden (Perpres) Nomor 16 Tahun 2018 tentang Perangkat
Daerah, yang mengubah Satuan Kerja Perangkat Daerah (SKPD) menjadi Organisasi
Perangkat Daerah (OPD), selain itu, penyebutan “Institusi” juga dilebur kepada
Lembaga, sehingga tidak perlu disebutkan lagi ke dalam penyebutan K/L, hal ini
dipertegas dengan penyebutan RKA K/L dan tidak pernah disebut RKA K/L/I, 2.
Penegasan ini disinkronkan dengan ketentuan ruang lingkup Peraturan Presiden
(Perpres) Nomor 16 Tahun 2018 yang menegaskan bahwa Perpres (Peraturan
Presiden) ini hanya berlaku untuk pengadaan yang dibiayai oleh APBN/APBD,
istilah “bersumber” atau “dibebankan” juga sudah tidak digunakan lagi untuk
menghindari kerancuan terhadap istilah penganggaran, dan 3. Awal dan akhir,
Peraturan Presiden (Perpres) Nomor 54 Tahun 2010 dan Perubahannya menegaskan
bahwa pengadaan dimulai dari perencanaan kebutuhan dan diakhiri dengan
diselesaikannya seluruh kegiatan untuk memperoleh barang/jasa, pengertian ini
lebih dipertajam pada Peraturan Presiden (Perpres) Nomor 16 Tahun 2018 yang
menegaskan bahwa pengadaan itu dimulai dari identifikasi kebutuhan dan diakhiri
dengan serah terima, hal ini untuk menghilangkan multi tafsir terhadap
pengertian pengadaan itu sendiri.

No. 26 Tahun 2007 Pasal 29 menjelaskan bahwa proporsi RTH (Ruang Terbuka Hijau)
wilayah kota minimal 30% dari luas wilayah kota, 2. Amanat Undang – Undang di
atas melahirkan upaya dalam perencanaan dan pengendalian tata ruang kota
khususnya terkait dengan RTH (Ruang Terbuka Hijau) Kota, 3. Penyediaan dan
pemanfaatan RTH (Ruang Terbuka Hijau) perkotaan sesuai dengan Permen (Peraturan
Menteri) PU (Pekerjaan Umum) Nomor 05 Tahun 2008, 4. Perlunya identifikasi
terhadap RTH (Ruang Terbuka Hijau). Kegiatan studi identifikasi Ruang Terbuka
Hijau (RTH) ini dimaksudkan untuk melakukan identifikasi dan mengukur potensi
RTH (Ruang Terbuka Hijau) yang terdapat di wilayah studi khususnya RTH (Ruang
Terbuka Hijau) Publik yang merupakan kewenangan Pemerintah Daerah. Dan juga
untuk dijadikan acuan oleh Pemerintah Daerah dalam rangka pembangunan RTH
(Ruang Terbuka Hijau). Ada pun tujuan kegiatan Studi Identifikasi Ruang Terbuka
Hijau (RTH) ini adalah 1. Mengidentifikasi jenis masing – masing RTH (Ruang
Terbuka Hijau), 2. Mengidentifikasi lokasi RTH (Ruang Terbuka Hijau), 3.
Menggambarkan kondisi eksisting RTH (Ruang Terbuka Hijau), 4. Mendokumentasikan
RTH (Ruang Terbuka Hijau) di wilayah studi, dan 5. Pembuatan aplikasi. Ruang
Terbuka Hijau (RTH) Kota adalah bagian dari ruang – ruang terbuka (open spaces) suatu wilayah perkotaan
yang diisi oleh tumbuhan, tanaman, vegetasi, (endemik, introduksi) guna
mendukung manfaat langsung dan/atau tidak langsung yang dihasilkan oleh RTH
(Ruang Terbuka Hijau) dalam kota tersebut yaitu keamanan, kenyamanan,
kesejahteraan, dan keindahan wilayah perkotaan tersebut (Departemen Pekerjaan
Umum, 2008). Typlogi RTH (Ruang Terbuka Hijau) yaitu 1. Fisik yaitu RTH (Ruang
Terbuka Hijau) Alami dan RTH (Ruang Terbuka Hijau) Non Alami, 2. Fungsi yaitu
ekologis, sosial budaya, estetika, dan ekonomi, 3. Struktur yaitu pola ekologis
dan pola planologis, dan 4. Kepemilikan yaitu RTH (Ruang Terbuka Hijau) Publik
dan RTH (Ruang Terbuka Hijau Privat). Tujuan penyelenggaraan RTH (Ruang Terbuka
Hijau) adalah 1. Menjaga ketersediaan lahan sebagai kawasan resapan air, 2.
Menciptakan aspek planologis perkotaan melalui keseimbangan antara lingkungan alam
dan lingkungan binaan yang berguna untuk kepentingan masyarakat, dan 3.
Meningkatkan keserasian lingkungan perkotaan sebagai sarana pengaman lingkungan
perkotaan yang aman, nyaman, segar, indah, dan bersih.

(Keputusan Menteri) PE (Pertambangan dan Energi) Nomor 1211K Tahun 1995 tentang
Pencegahan dan Penanggulangan Perusakan dan Pencemaran Lingkungan pada Kegiatan
Usaha Pertambangan Umum yang meliputi pencegahan dan penanggulangan perusakan
dan pencemaran lingkungan adalah salah satu upaya terpadu dalam pelaksanaan
pengelolaan dan pemantauan lingkungan sehingga tercapai tujuan pemanfaatan,
penaatan, pemeliharaan, pengawasan, pengendalian, pemulihan, dan pengembangan
lingkungan pada kegiatan usaha pertambangan umum. Kewajiban Pengusaha
Pertambangan yaitu 1. Mengalokasikan biaya dan fasilitas untuk perlindungan
lingkungan, 2. Memberikan pendidikan dan pelatihan kepada karyawan mengenai
perlindungan lingkungan, 3. Menunjuk KTT (Kepala Teknik Tambang) untuk memimpin
langsung dalam pelaksanaan perlindungan lingkungan [Pasal 04 Kepmen (Keputusan
Menteri) PE (Pertambangan dan Energi) Nomor 1211K Tahun 1995], 4. Bila KTT
(Kepala Teknik Tambang) berhalangan di lapangan maka perusahaan menunjuk
petugas melaksanakan kewajiban KTT (Kepala Teknik Tambang), 5. Menyampaikan
Rencana Tahunan Pengelolaan dan Pemantauan Lingkungan kepada KaPIT (Kepala
Pelaksana Inspektur Tambang), dan 6. Menempatkan dana jaminan pelaksanaan
reklamasi.

directly in the implementation of environmental protection (Article 04 of

of Mining Engineering is absent in the field then the company appoints officers
to perform the obligations of The Head of Mining Engineering, 5. Deliver the
Annual Plan of Environmental Management and Monitoring to The Head of Implementing

lingkungan, 1.2. jumlah pengadaan, penggunaan, penyimpanan, dan persediaan B3
(Bahan Berbahaya Beracun), 1.3. gejala yang berpotensi menimbulkan perusakan
dan/atau pencemaran lingkungan, dan 1.4. terjadinya perusakan dan/atau
pencemaran lingkungan berikut upaya penanggulangannya dalam waktu 01 x 24 jam
(satu kali dua puluh empat jam), 2. Menetapkan tata cara baku untuk menanggulangi
perusakan dan pencamaran lingkungan pada tempat – tempat yang berpotensi
menimbulkan perusakan dan pencemaran lingkungan, 3. Melakukan upaya pencegahan
atas kemungkinan perusakan dan pencemaran lingkungan, 4. Melakukan revegetasi
sesuai dengan AMDAL (Analisa Mengenai Dampak Lingkungan) atau UKL/UPL (Upaya
Pengelolaan Lingkungan / Upaya Pemantauan Lingkungan), 5. Membuat peta
pengelolaan dan pemantauan lingkungan, dan 6. Memeriksa tailing yang mengandung B3 (Bahan Berbahaya Beracun) secara berkala
dan melaporkannnya kepada KaPIT (Kepala Pelaksana Inspektur Tambang).
