Nomor 27 Tahun 2012 (PP 27/2012) tentang Perizinan Lingkungan. Perizinan
Lingkungan adalah izin yang diberikan kepada setiap orang melakukan usaha
dan/atau kegiatan yang wajib AMDAL (Analisa Mengenai Dampak Lingkungan) atau
UKL – UPL (Upaya Pengelolaan Lingkungan – Upaya Pemantauan Lingkungan) dalam
rangka perlindungan dan pengelolaan lingkungan hidup sebagai prasyarat
memperoleh izin usaha dan/atau kegiatan. AMDAL (Analisa Mengenai Dampak
Lingkungan) adalah kajian mengenai penting suatu usaha dan/atau kegiatan yang
direncanakan pada lingkungan hidup yang diperlukan bagi proses pengambilan
keputusan tentang penyelenggaraan usaha dan/atau kegiatan. Dampak penting
adalah perubahan lingkungan hidup yang sangat mendasar yang diakibatkan oleh
suatu usaha dan/atau kegiatan. Keputusan Kelayakan Lingkungan Hidup adalah
keputusan yang menyatakan kelayakan lingkungan hidup dari suatu rencana usaha
dan/atau Kegiatan yang wajib dilengkapi dengan AMDAL (Analisa Mengenai Dampak
Lingkungan). Izin Usaha dan/atau Kegiatan adalah izin yang diterbitkan oleh
instansi teknis untuk melakukan Usaha dan/atau kegiatan yang akan dilaksanakan.
Penyusunan analisis mengenai dampak lingkungan hidup dapat dilakukan melalui
pendekatan studi terhadap kegiatan tunggal, terpadu atau kegiatan dalam
kawasan. Permohonan Izin Lingkungan diajukan secara tertulis oleh
penanggungjawab usaha bersamaan dengan pengajuan penilaian Andal (Analisis
Dampak Lingkungan) dan RKL – RPL (Rencana Pengelolaan Lingkungan – Rencana
Pemantauan Lingkungan) atau pemeriksaan.
Permohonan Izin Lingkungan dilengkapi dengan dokumen AMDAL (Analisa Mengenai
Dampak Lingkungan) atau formulir UKL – UPL (Upaya Pengelolaan Lingkungan –
Upaya Pemantauan Lingkungan), dokumen pendirian usaha dan/atau kegiatan, dan
profil usaha dan/atau kegiatan.

Permit is a permit granted to every person undertaking a business and / or
activity required by Environmental Impact Assessment or Environmental
Management Effort - Environmental Monitoring Effort in the framework of
environmental protection and management as a prerequisite to obtain business
license and / or activity. Environmental Impact Assessment is an important
study of an undertaking and / or activity planned on the environment is
necessary for the decision-making process on the conduct of business and /or
activities. An important impact is the very basic environmental change caused
by a business and / or activity. The Environmental Feasibility Decision is a
decree stating the environmental feasibility of a plan of business and / or
Activity that must be completed with Environmental Impact Analysis. License of Business
and / or Activity is a license issued by a technical agency to conduct business
and / or activities to be implemented. The preparation of an analysis of
environmental impacts can be done through a study approach to a single activity,
integrated or in-region activity. An Environmental License application shall be
filed in writing by the business person in conjunction with the filing of the Environmental
Impact Assessment and the Environmental Management Plan – the Environmental
Monitoring Plan or examination. The Environmental Permit Application is
completed with an Environmental Impact Assessment or form of Environmental
Management Effort - Environmental Monitoring Effort, start - up documents of business
and / or activity and business profile and / or activity profile.

Perubahan dalam penggunaan alat – alat produksi, b. Penambahan kapasitas
produksi, c. Perubahan spesifikasi teknis, d. Perubahan sarana usaha dan/atau
kegiatan, e. Perluasan lahan bangunan, f. Perubahan waktu atau durasi operasi
usaha/kegiatan, g. Berada dalam kawasan lindung yang belum tercantum dalam IL
(Izin Lingkungan), h. Terjadi perubahan kebijakan dari Pemerintah, dan i.
Terjadi perubahan lingkungan hidup yang sangat mendasar, (4) terdapat perubahan
dampak dan/atau risiko terhadap lingkungan hidup berdasarkan hasil kajian
analisis risiko lingkungan hidup yang diwajibkan, dan (5) tidak dilaksanakan
rencana usaha dan/atau kegiatan yang bersangkutan dalam jangka waktu 3 (tiga)

Pertambangan Khusus), Pasal 16 pengawasan sebagaimana dimaksud Paal 13 ayat (2)
meliputi pengelolaan LH (Lingkungan Hidup), reklamasi, dan pascatambang.
Peraturan Pemerintah Nomor 55 Tahun 2010 tentang Pembinaan dan Pengawasan,
Pasal 28 ayat (1) pengawasan pengelolaan LH (Lingkungan Hidup), reklamasi, dan
pascatambang, paling sedikit meliputi a. Pengelolaan dan pemantauan LH
(Lingkungan Hidup) sesuai dokumen LH (Lingkungan Hidup) atau Izin LH
(Lingkungan Hidup), b. Penataan, pemulihan, dan perbaikan lahan sesuai dengan
peruntukannya, c. Penetapan dan pencairan jaminan reklamasi, d. Pengelolaan
pascatambang, e. Penetapan dan pencairan jaminan pascatambang, dan f. Pemenuhan
baku mutu LH (Lingkungan Hidup), Pasal 28 ayat (2) pengawasan sebagaimana
dimaksud pada ayat (1) dilakukan oleh IT (Inspektur Tambang) dan berkoordinasi
dengan pejabat pengawas di bidang LH (Lingkungan Hidup) dan reklamasi.

means in business and / or activities, e. Expansion of building area, f. Change
of time or duration of business / activity operation, g. Be in a protected area
not listed in Environmental Permit, h. Policy changes from the Government, and
i. There is a substantial environmental change, (4) there is a change of impact
and / or risk to the environment based on the assessment of the required
environmental risk analysis, and (5) no plan of business and / or activity has
been implemented within 3 three years. The Head of The Politburo of

Centre of Development for Policy and Strategy of The Neighborhood Leadership
Assembly of The Great Mandailing Foundation to up date by understanding
Government Regulation No. 55/2010 on Development and Supervision, Article 13
paragraph (2) ministers, governors , or the regent / mayor shall supervise the
implementation of mining business activities conducted by Mining Business
License), Mining Permit for the People, and Special Mining Business License,
Article 16 supervision as meant in Article 13 paragraph (2) management of
Environment, reclamation and post-mining. Government Regulation No. 55/2010
concerning Guidance and Supervision, Article 28 paragraph (1) supervision of
Environment, reclamation and post-mining management, shall at least include a.
Management and monitoring of Environment as per document of Environment or
Permit of Environment, b. Arrangement, recovery and improvement of land in
accordance with its designation, c. Determination and disbursement of
reclamation guarantee, d. Post-mining management, e. Assignment and
disbursement of post-mining guarantees, and f. The fulfillment of Environment
quality standard, Article 28 paragraph (2) supervision as referred to in paragraph
(1) shall be done by Mining Inspector and coordinate with supervisory officer
in Environment and reclamation field.

berhubungan dengan Tata Laksana Reklamasi dan Pasca Tambang yaitu 1. Perusahaan
pemegang IUP (Izin Usaha Pertambangan) atau IUPK (Izin Usaha Pertambangan
Khusus) Eksplorasi wajib menyusun dan menyampaikan Rencana Reklamasi dan
Rencana Pasca Tambang sebelum memulai kegiatan eksplorasi, 2. Rencana Reklamasi
disusun untuk jangka waktu pelaksanaan 5 (lima) tahun dengan rincian tahunan,
3. Rencana Reklamasi dan Rencana Penutupan Tambang disusun berdasarkan AMDAL
(Analisa Mengenai Dampak Lingkungan) atau UKL – UPL (Usaha Pengelolaan
Lingkungan dan Usaha Pemantauan Lingkungan) yang telah disetujui, 4. Dalam hal
reklamasi berada dalam kawasan hutan, pesisir dan pulau – pulau kecil,
penilaian keberhasilan reklamasi dilakukan sesuai ketentuan peraturan perundang
– undangan, 5. Pemegang IUP (Izin Usaha Pertambangan) atau IUPK (Izin Usaha
Pertambangan Khusus) yang telah menyelesaikan studi kelayakan harus mengajukan
persetujuan Rencana Reklamasi disampaikan kepada menteri, gubernur,
bupati/walikota sesuai kewenangan masing – masing sesuai dengan kewenangan
masing – masing, 6. Permohonan persetujuan Rencana Reklamasi dan Pasca Tambang
diajukan bersamaan dengan pengajuan permohonan IUP (Izin Usaha Pertambangan)
atau IUPK (Izin Usaha Pertambangan Khusus) Operasi Produksi, dan 7. Penyusunan
Rencana Pasca Tambang harus berkonsultasi dengan instansi Pemerintah serta
instansi di daerah (yang membidangi pertambangan) instansi terkait lainnya
serta masyarakat setempat.

The holder of Mining Business License or Special Mining Business License that
has completed the feasibility study shall propose the approval of the
Reclamation Plan submitted to the ministers, governors, regents / mayors
accordingly their respective authorities in accordance with their respective
authorities, 6. The request for approval of the Post-Mining Reclamation Plan
shall be filed simultaneously with the application of Mining Business License)
