b. Pelaksanaan Reklamasi
2) Pelaksanaan Reklamasi tahap kegiatan Operasi Produksi
a) Pemegang IUP tahap kegiatan Operasi Produksi atau pemegang
IUPK tahap kegiatan Operasi Produksi wajib melaksanakan Reklamasi yang telah
disetujui;
b) Pelaksanaan Reklamasi tahap kegiatan Operasi Produksi
dilakukan segera setelah kegiatan berakhir;
c) Dalam hal lahan pada huruf b) di atas direncanakan untuk
digunakan kembali, pemegang IUP tahap kegiatan Operasi Produksi atau pemegang
IUPK tahap kegiatan Operasi Produksi wajib melakukan pengendalian kualitas air
permukaan, erosi, dan sedimentasi; dan
d) Dalam hal terdapat realisasi bukaan lahan pada tahun
tertentu yang melebihi rencana bukaan lahan pada tahun tertentu yang telah
disetujui dalam dokumen rencana Reklamasi tahap kegiatan Operasi Produksi,
kelebihan bukaan lahan tersebut wajib dijaminkan melalui mekanisme perubahan
rencana Reklamasi tahap kegiatan Operasi Produksi yang telah disetujui atau
dalam penyusunan rencana Reklamasi tahap kegiatan Operasi Produksi periode
berikutnya.
b. Implementation of
Reclamation
2) Implementation of
Reclamation during the Production Operations phase
a) Holders of Mining
Business Permits during the Production Operations phase or holders of Special
Mining Business Permits during the Production Operations phase are required to
implement the approved Reclamation;
b) Reclamation during
the Production Operations phase is carried out immediately after the activity
ends;
c) If the land referred
to in letter b) above is planned for reuse, holders of Mining Business Permits
during the Production Operations phase or holders of Mining Business Permits
during the Production Operations phase are required to control surface water
quality, erosion, and sedimentation; and
d) If land clearing in
a given year exceeds the land clearing plan approved in the Reclamation plan
for the Production Operations phase, the excess land clearing must be secured
through a mechanism to amend the approved Reclamation plan for the Production
Operations phase or in the preparation of the Reclamation plan for the next
Production Operations phase.
