Ketentuan Kewajiban Terms of Obligation |
a. |
Dalam hal Survei Umum dilaksanakan di Wilayah Terbuka seluruhnya,
setelah Izin Survei Umum diterbitkan, pelaku usaha wajib: In the event that a General
Survey is carried out entirely in an Open Area, after the General Survey
Permit is issued, the business actor is obliged to: |

|
|
b. |
Dalam hal Survei Umum melintasi Wilayah Kerja aktif, setelah Izin
Survei Umum diterbitkan, pelaku usaha wajib: In the case of a General Survey
crossing an active Work Area, after the General Survey Permit is issued, the
business actor is obliged to: |
||
|
|
|
|
1) |
melakukan kegiatan Survei Umum dan Izin Survei Umum tidak dapat
dialihkan kepada pihak lain; carry out General Survey
activities and General Survey Permits cannot be transferred to other parties; |
|
|
|
|
|
2) |
selama pelaksanaan Survei Umum, pelaku usaha wajib melaporkan
perkembangan pelaksanaan Survei Umum kepada Direktorat Jenderal Minyak dan
Gas Bumi secara berkala minimal 3 (tiga) bulan sekali atau setiap saat
apabila diperlukan. During the implementation of
the General Survey, business actors are required to report the progress of
the implementation of the General Survey to the Directorate General of Oil
and Gas periodically at least once every 3 (three) months or at any time if
necessary. |

|
|
|
|
3) |
dalam hal terjadi perubahan, baik luasan area/panjang lintasan/jumlah
titik dan/atau lokasi survei di luar wilayah yang tercakup dalam Izin Survei
Umum, pelaku usaha wajib: In the event of changes, either
to the area/length of the route/number of points and/or survey location
outside the area covered by the General Survey Permit, the business actor is
obliged to: |
|
|
|
|
|
|
a) |
mempertahankan pelaksanaan realisasi minimal 70% (tujuh puluh persen)
di Wilayah Terbuka; maintain the implementation of
a minimum realization of 70% (seventy percent) in the Open Area; |
|
|
|
|
|
b) |
melaporkan kepada Direktur Jenderal Minyak dan Gas Bumi c.q. Direktur
Pembinaan Usaha Hulu Minyak dan Gas Bumi; report to the Director General
of Oil and Gas c.q. Director of Upstream Oil and Gas Business Development; |
|
|
|
|
4) |
dalam hal terdapat perubahan luasan area/panjang lintasan/jumlah
titik Survei Umum yang melebihi 20% (dua puluh persen) dari total luasan
area/panjang lintasan/jumlah titik Survei Umum yang tertuang dalam Izin
Survei Umum, pelaku usaha wajib terlebih dahulu menyampaikan permohonan penyesuaian
izin kepada Kepala BKPM setelah melakukan presentasi ke Direktorat Jenderal
Minyak dan Gas Bumi; in the event that there is a
change in the area/length of the route/number of General Survey points that
exceeds 20% (twenty percent) of the total area/length of the route/number of
General Survey points stated in the General Survey Permit, the business actor
must first submit a request for adjustment of the permit to the Head of the
Investment Coordinating Board after making a presentation to the Directorate
General of Oil and Gas; |
|
|
|
|
|
5) |
apabila kontrak kerja sama penyimpanan, pemeliharaan, dan
pemasyarakatan data dengan Pusdatin ESDM telah dilakukan sebelum adanya
perubahan izin, terhadap kontrak kerja sama penyimpanan, pemeliharaan, dan pemasyarakatan
data tersebut wajib dilakukan amandemen setelah terbitnya perubahan izin
sebagaimana dimaksud pada angka 4) ; if the cooperation contract for
data storage, maintenance and socialization with the Energy and Mineral
Resources Data and Information Center has been carried out before the change
in permit, the cooperation contract for data storage, maintenance and
socialization must be amended after the issuance of the change in permit as
referred to in number 4); |
|
|
|
|
|
6) |
apabila ketentuan angka 3), angka 4), dan angka 5) tidak dipenuhi,
data tambahan yang dihasilkan dari perubahan luasan area/panjang
lintasan/jumlah titik dan/atau lokasi survei tersebut wajib diserahkan kepada
Pusdatin ESDM setelah dievaluasi oleh Direktorat Jenderal Minyak dan Gas Bumi
dan Data tersebut menjadi milik negara serta pelaku usaha tidak memiliki hak
pemasyarakatan atas Data tambahan tersebut; if the provisions of numbers
3), 4), and 5) are not met, additional data resulting from changes in the
area/length of the track/number of points and/or location of the survey must
be submitted to the Energy and Mineral Resources Data and Information Center
after being evaluated by the Directorate General of Oil and Gas and the data
becomes the property of the state and business actors do not have the right
to publicize the additional data; |

|
7) |
luasan area/panjang lintasan/jumlah titik hasil survei umum yang
dapat dimasukkan dalam Kontrak Kerja Sama penyimpanan, pemeliharaan, dan
pemasyarakatan data dengan Pusdatin ESDM tetap wajib memenuhi minimal 70%
(tujuh puluh persen) dari realisasi pelaksanaan Survei Umum di Wilayah
Terbuka serta data hasil Survei Umum yang tidak masuk dalam lingkup kontrak
kerja sama penyimpanan, pemeliharaan, dan pemasyarakatan data tersebut wajib
diserahkan kepada Pusdatin ESDM setelah dievaluasi oleh Direktorat Jenderal
Minyak dan Gas Bumi dan Data tersebut menjadi milik negara serta pelaku usaha
tidak memiliki hak pemasyarakatan atas Data tersebut; the area/length of the
track/number of points resulting from the general survey that can be included
in the Cooperation Contract for storage, maintenance and dissemination of
data with the Energy and Mineral Resources Data and Information Center must
still fulfill a minimum of 70% (seventy percent) of the realization of the
implementation of the General Survey in the Open Area and the data resulting
from the General Survey that is not included in the scope of the cooperation
contract for storage, maintenance and dissemination of the data must be
submitted to the Energy and Mineral Resources Data and Information Center
after being evaluated by the Directorate General of Oil and Gas and the Data
becomes the property of the state and business actors do not have the right
to disseminate the Data; |

|
|
|
8) |
mengadakan Kontrak Kerja Sama dengan Pusdatin ESDM mengenai
penyimpanan, pemeliharaan dan pemasyarakatan data, dengan ketentuan dan
mekanisme sebagai berikut: enter into a Cooperation
Contract with the Energy and Mineral Resources Data and Information Center
regarding data storage, maintenance and dissemination, with the following
provisions and mechanisms: |

|
|
|
a) |
Badan Usaha wajib menindaklanjuti Izin Survei Umum tersebut dengan
kontrak kerja sama penyimpanan, pemeliharaan, dan pemasyarakatan data antara
Badan Usaha dengan Pusdatin ESDM dan apabila sampai pada akhir masa
berlakunya Izin Survei Umum, Badan Usaha tidak memiliki kontrak kerja sama
penyimpanan, pemeliharaan, dan pemasyarakatan data tersebut, Izin Survei Umum
dinyatakan tidak berlaku dan seluruh data hasil kegiatan Survei Umum wajib
diserahkan kepada Pemerintah c.q. Pusdatin ESDM; The Business Entity is required
to follow up the General Survey Permit with a cooperation contract for data
storage, maintenance and socialization between the Business Entity and the
Energy and Mineral Resources Data and Information Center and if at the end of
the validity period of the General Survey Permit, the Business Entity does
not have a cooperation contract for data storage, maintenance and
socialization, the General Survey Permit is declared invalid and all data
resulting from the General Survey activities must be submitted to the
Government c.q. Energy and Mineral Resources Data and Information Center; |
|
|
|
|
|
b) |
Izin Survei Umum yang terdiri dari area di Wilayah Terbuka dan area
di Wilayah Kerja aktif yang dilintasi akan dituangkan pada 1 (satu) Kontrak
Kerja Sama penyimpanan, pemeliharaan, dan pemasyarakatan data antara pelaku
usaha dan Pusdatin ESDM; General Survey Permits
consisting of areas in Open Areas and areas in active Work Areas that are
crossed will be stated in 1 (one) Cooperation Contract for data storage,
maintenance and dissemination between business actors and the Energy and
Mineral Resources Data and Information Center; |
|
|
|
|
|
c) |
Kontrak kerja sama dengan Pusdatin ESDM dapat dilakukan setelah Izin
Survei Umum diterbitkan, dengan tanggal efektif kontrak yaitu sejak memenuhi
realisasi luasan area/panjang lintasan/jumlah titik Survei Umum minimal 51%
(lima puluh satu persen) di Wilayah Terbuka berdasarkan hasil pemantauan
pelaksanaan Survei Umum oleh Direktorat Jenderal Minyak dan Gas Bumi; A cooperation contract with the
Energy and Mineral Resources Data and Information Center can be carried out
after the General Survey Permit is issued, with the effective date of the
contract being from the time the realization of the area/length of the
track/number of General Survey points of at least 51% (fifty-one percent) in
the Open Area is fulfilled based on the results of monitoring the
implementation of the General Survey by the Directorate General of Oil and
Gas; |
|
|
|
|
|
d) |
apabila realisasi luasan area/panjang lintasan/jumlah titik Survei
Umum lebih kecil dari yang tertuang dalam izin Survei Umum (termasuk
perubahan izinnya jika ada), akan mengurangi secara proporsional jangka waktu
Kontrak Kerja penyimpanan, sama pemeliharaan, dan pemasyarakatan data, If the actual area/length of
the track/number of General Survey points is smaller than that stated in the
General Survey permit (including changes to the permit if any), the Work
Contract period for data storage, maintenance and socialization will be
reduced proportionally. |
|
|
|
|
9) |
Pelaku usaha wajib menyampaikan dokumen perjanjian dengan pihak
ketiga kepada Pusdatin ESDM terkait dengan antara lain pelaksanaan Survei
Umum dan penyimpanan, pemeliharaan, dan pemasyarakatan data hasil kegiatan
Survei Umum; Business actors are required to
submit agreement documents with third parties to the Energy and Mineral
Resources Data and Information Center regarding, among other things, the
implementation of General Surveys and the storage, maintenance and
dissemination of data resulting from General Survey activities; |
|
|
|
|
|
10) |
Pelaku usaha wajib bertanggung jawab sepenuhnya terhadap penguasaan
di dalam kegiatan penyimpanan, pengelolaan dan kegiatan pemasyarakatan data
hasil kegiatan survei umum; Business actors are required to
be fully responsible for controlling the storage, management and
socialization activities of data resulting from general survey activities; |
|
|
|
|
|
11) |
Pelaku usaha wajib menyerahkan snapshot
dan salinan atas data Survei Umum yang diperoleh termasuk daftar seluruh
datanya kepada Pusdatin ESDM melalui Direktorat Jenderal Minyak dan Gas Bumi
dan mempresentasikan hasil Survei Umum kepada Direktorat Jenderal Minyak dan
Gas Bumi sesuai dengan ketentuan peraturan perundang -undangan. Business actors are required to
submit snapshots and copies of the General Survey data obtained, including a
list of all data, to the Energy and Mineral Resources Data and Information
Center through the Directorate General of Oil and Gas and present the results
of the General Survey to the Directorate General of Oil and Gas in accordance
with the provisions of laws and regulations. |
