PRESIDENT OF THE REPUBLIC OF INDONESIA,

Pasal 1
Dalam Undang-Undang ini yang dimaksud dengan :
Article 1
In this Law what is meant by :

39. Ketentuan Pasal 47 diubah sehingga berbunyi sebagai berikut :

Pasal 47

Jangka waktu kegiatan Operasi Produksi sebagaimana dimaksud dalam Pasal 36 ayat (1) huruf b diberikan dengan ketentuan :

a. untuk Pertambangan Mineral logam paling lama 20 (dua puluh) tahun dan dijamin memperoleh perpanjangan 2 (dua) kali masing-masing 10 (sepuluh) tahun setelah memenuhi persyaratan sesuai dengan ketentuan peraturan perundang-undangan.

b. untuk Pertambangan Mineral bukan logam paling lama 10 (sepuluh) tahun dan dijamin memperoleh perpanjangan 2 (dua) kali masing-masing 5 (lima) tahun setelah memenuhi persyaratan sesuai dengan ketentuan peraturan perundang-undangan.

c. untuk Pertambangan Mineral bukan logam jenis tertentu paling lama 20 (dua puluh) tahun dan dijamin memperoleh perpanjangan 2 (dua) kali masing-masing 10 (sepuluh) tahun setelah memenuhi persyaratan sesuai dengan ketentuan peraturan perundang-undangan.

d. untuk Pertambangan batuan paling lama 5 (lima) tahun dan dijamin memperoleh perpanjangan 2 (dua) kali masing-masing 5 (lima) tahun setelah memenuhi persyaratan sesuai dengan ketentuan peraturan perundang-undangan.

e. untuk Pertambangan Batubara paling lama 20 (dua puluh) tahun dan dijamin memperoleh perpanjangan 2 (dua) kali masing-masing 10 (sepuluh) tahun setelah memenuhi persyaratan sesuai dengan ketentuan peraturan perundang-undangan.

f. untuk Pertambangan Mineral logam yang terintegrasi dengan fasilitas pengolahan dan/atau pemurnian selama 30 (tiga puluh) tahun dan dijamin memperoleh perpanjangan selama 10 (sepuluh) tahun setiap kali perpanjangan setelah memenuhi persyaratan sesuai dengan ketentuan peraturan perundang-undangan.

g. untuk Pertambangan Batubara yang terintegrasi dengan kegiatan Pengembangan dan/atau Pemanfaatan selama 30 (tiga puluh) tahun dan dijamin memperoleh perpanjangan selama 10 (sepuluh) tahun setiap kali perpanjangan setelah memenuhi persyaratan sesuai dengan ketentuan peraturan perundang-undangan.

39. The provisions of Article 47 are amended to read as follows:

Article 47

The period for Production Operation activities as intended in Article 36 paragraph (1) letter b is provided with the following provisions:

a. for Metal Mineral Mining, the maximum period is 20 (twenty) years and is guaranteed to obtain an extension of 2 (two) times of 10 (ten) years each after fulfilling the requirements in accordance with the provisions of statutory regulations.

b. for non-metallic mineral mining, the maximum period is 10 (ten) years and is guaranteed to obtain an extension of 2 (two) times of 5 (five) years each after fulfilling the requirements in accordance with the provisions of statutory regulations.

c. for certain types of non-metallic mineral mining, the maximum period is 20 (twenty) years and is guaranteed to obtain an extension of 2 (two) times of 10 (ten) years each after fulfilling the requirements in accordance with the provisions of statutory regulations.

d. for rock mining, the maximum period is 5 (five) years and is guaranteed to obtain an extension of 2 (two) times of 5 (five) years each after fulfilling the requirements in accordance with the provisions of statutory regulations.

e. for Coal Mining for a maximum of 20 (twenty) years and is guaranteed to obtain an extension of 2 (two) times of 10 (ten) years each after fulfilling the requirements in accordance with the provisions of statutory regulations.

f. for metal mineral mining which is integrated with processing and/or refining facilities for 30 (thirty) years and is guaranteed to obtain an extension of 10 (ten) years each time after fulfilling the requirements in accordance with the provisions of statutory regulations.

g. for Coal Mining which is integrated with Development and/or Utilization activities for 30 (thirty) years and is guaranteed to obtain an extension of 10 (ten) years for each extension after fulfilling the requirements in accordance with the provisions of statutory regulations.
