BY THE GRACE OF GOD ALMIGHTY
PRESIDENT OF THE REPUBLIC OF INDONESIA,

Pasal 1
Dalam Undang-Undang ini yang dimaksud dengan :
Article 1
In this Law what is meant by :

Pasal 14A

Wilayah dalam WP yang dapat ditentukan sebagai WUP harus memenuhi kriteria:

a. memiliki sebaran formasi batuan pembawa, data indikasi, data sumber daya, dan/atau data cadangan Mineral dan/atau Batubara;

b. memiliki 1 (satu) atau lebih jenis Mineral termasuk Mineral ikutannya dan/atau Batubara;

c. tidak tumpang tindih dengan WPR, WPN, dan/atau WUPK;

d. merupakan wilayah yang dapat dimanfaatkan untuk kegiatan Pertambangan secara berkelanjutan ;

e. merupakan eks wilayah IUP yang telah berakhir atau dicabut; dan/atau

f. merupakan wilayah hasil penciutan atau pengembalian wilayah IUP.

Article 14A

Areas within a WP (in Bahasa) that can be designated as WUP (in Bahasa) must meet the following criteria:

a. has the distribution of carrier rock formations, indication data, resource data, and/or Mineral and/or Coal reserve data;

b. has 1 (one) or more types of Minerals including associated Minerals and/or Coal;

c. does not overlap with WPR (in Bahasa), WPN (in Bahasa), and/or WUPK (in Bahasa);

d. is an area that can be utilized for sustainable mining activities;

e. is a former IUP (in Bahasa) area that has expired or been revoked; and/or

f. is the area resulting from the reduction or return of the IUP (in Bahasa) area.
