YMR (Majelis Pimpinan Rukun Tetangga Yayasan Mandailing Raya) untuk meng-update ilmu mekanika dengan memahami
Undang – Undang Nomor 04 Tahun 2009 tentang Pertambangan Mineral dan Batubara
yang berhubungan dengan defenisi – defenisi yaitu Reklamasi adalah kegiatan
yang dilakukan sepanjang tahapan usaha pertambangan untuk menata, memulihkan,
dan memperbaiki kualitas lingkungan dan ekosistem agar dapat berfungsi kembali
sesuai peruntukannya. Pascatambang adalah kegiatan terencana, sistematis, dan
berlanjut setelah akhir sebahagian atau seluruh kegiatan usaha pertambangan
untuk memulihkan fungsi lingkungan alam dan fungsi sosial menurut kondisi lokal
di seluruh wilayah pertambangan. Pemberdayaan masyarakat adalah usaha untuk
meningkatkan kemampuan masyarakat, baik secara individual maupun kolektif, agar menjadi lebih baik tingkat
kehidupannya. Pasal 95 Undang – Undang Nomor 04 Tahun 2009 Pemegang IUP (Izin
Usaha Pertambangan) dan IUPK (Izin Usaha Pertambangan Khusus) wajib menerapkan
kaidah teknik pertambangan yang baik, mengelola keuangan sesuai dengan sistem
akuntansi Indonesia, meningkatkan nilai tambah sumber daya mineral dan/atau
batubara, dan mematuhi batas toleransi daya dukung lingkungan.

the science of mechanics to understand Act No. 04 of 2009 on Mineral and Coal
Mining related with the definitions - Reclamation is the activity undertaken
throughout the mining business stages to organize, restore, and improve the
quality of the environment and ecosystem in order to function again according
to its allocation. Post-mining is a planned, systematic and continuous activity
after the end of part or all of the mining business activities to restore the
function of the natural environment and social functions according to local
conditions throughout the mining area. Community empowerment is an effort to
improve the ability of the community, both individually and collectively, in
order to better the level of life. Article 95 of the Law Number 04 Year 2009 of
Mining Business License and Permit of Special Mining shall apply rules mining
technique was good, manage finances in accordance with Indonesian accounting
system, increase the added value of mineral resources and / or coal, and adhere
to the tolerance limits of environmental carrying capacity.

YMR (Majelis Pimpinan Rukun Tetangga Yayasan Mandailing Raya) untuk meng-update dengan memahami Pasal 96 Undang –
Undang Nomor 04 Tahun 2009 Dalam penerapan kaidah teknik pertambangan yang
baik, pemegang IUP (Izin Usaha Pertambangan) dan IUPK (Izin Usaha Pertambangan
Khusus) wajib melaksanakan ketentuan Keselamatan dan Kesehatan Kerja
Pertambangan, keselamatan operasi pertambangan, pengelolaan dan pemantauan
lingkungan pertambangan, termasuk kegiatan reklamasi dan pascatambang, upaya
konservasi sumber daya mineral dan
batubara, dan pengelolaan sisa tambang dari suatu kegiatan usaha pertambangan
dalam bentuk padat, cair, atau gas sampai memenuhi standar baku mutu lingkungan
sebelum dilepas di media lingkungan.
Pasal 97 Undang – Undang Nomor 04 Tahun 2009 Pemegang IUP (Izin Usaha
Pertambangan) dan IUPK (Izin Usaha Pertambangan Khusus) wajib menjamin
penerapan standar dan baku mutu lingkungan sesuai dengan karakteristik suatu
daerah. Pasal 98 Undang – Undang Nomor 04 Tahun 2009 pemegang IUP (Izin Usaha
Pertambangan) dan IUPK (Izin Usaha Pertambangan Khusus) wajib menjaga
kelestarian fungsi dan daya dukung sumber daya air yang bersangkutan sesuai
dengan Peraturan Per-UU-an (Perundang-undangan). Undang – Undang Nomor 04 Tahun
2009 Pasal 99 ayat (1) setiap Pemegang IUP (Izin Usaha Pertambangan) dan IUPK
(Izin Usaha Pertambangan Khusus) wajib menyerahkan Rencana Reklamasi dan
Rencana Pascatambang pada saat mengajukan Permohonan IUP (Izin Usaha
Pertambangan) Operasi Produksi dan Pasal 99 ayat (2) pelaksanaan reklamasi dan
kegiatan pascatambang dilakukan sesuai dengan peruntukan lahan pascatambang.

including reclamation and post-mining activities, conservation of mineral and
coal resources, and management of mine waste from a mining business activity in
solid, liquid, or gas form to meet environmental quality standards before being
released in the environmental media. Article 97 of Law Number 04 Year 2009
Holders of IUP Mining Business License and Special Mining Business License
shall ensure the application of environmental standards and standards in
accordance with the characteristics of a region. Article 98 of Law Number 04
Year 2009 holders of Mining Business License and Special Mining Business
License shall maintain the preservation of the function and carrying capacity
of water resources concerned in accordance with the Regulation of Law
(Legislation). Law Number 04 Year 2009 Article 99 paragraph (1) each Holders of

bupati/walikota sesuai dengan kewenangannya dapat menetapkan pihak ketiga untuk
melakukan reklamasi dan pasca tambang dengan dana jaminan tersebut, dan Pasal
100 ayat (3) ketentuan sebagaimana dimaksud pada ayat (2) diberlakukan apabila pemegang
IUP (Izin Usaha Pertambangan) dan IUPK (Izin Usaha Pertambangan Khusus) tidak
melaksanakan reklamasi dan pasca tambang sesuai dengan rencana yang telah
disetujui. Undang – Undang Nomor 32 Tahun 1999 tentang Perlindungan Pengelolaan
Lingkungan Hidup, Pasal 4 Perlindungan dan Pengelolaan Lingkungan Hidup
meliputi a. Perencanaan, b. Pemanfaatan, c. Pengendalian, d. Pengawasan, dan e.
Penegakan hukum. Undang – Undang Nomor 32 Tahun 1999 Pasal 32 ayat (1) setiap
usaha dan/atau kegiatan yang berdampak penting terhadap lingkungan hidup wajib
memiliki AMDAL (Analisa Mengenai Dampak Lingkungan), Undang – Undang Nomor 32
Tahun 1999 Pasal 34 ayat (1) setiap usaha dan/atau kegiatan yang tidak termasuk
dalam kriteria wajib dampak penting wajib memiliki UKL-UPL (Upaya Pengelolaan
Lingkungan – Upaya Pemantauan Lingkungan), Undang – Undang Nomor 32 Tahun 1999
Pasal 36 ayat (1) setiap usaha dan/atau kegiatan yang wajib memiliki AMDAL
(Analisa Mengenai Dampak Lingkungan) atau UKL-UPL (Upaya Pengelolaan Lingkungan
– Upaya Pemantauan Lingkungan) wajib memiliki izin lingkungan, Undang – Undang
Nomor 32 Tahun 1999 Pasal 49 ayat (1) menteri mewajibkan audit lingkungan hidup kepada a. Usaha dan/atau kegiatan tertentu
yang berisiko tinggi terhadap lingkungan hidup dan b. Penanggung jawab usaha
dan/atau kegiatan yang menunjukkan ketidaktaatan terhadap peraturan perundang –
undangan.

penjara paling singkat 3 (tiga) tahun dan paling lama 10 (sepuluh) tahun dan
denda paling sedikit Rp3 milyar (tiga milyar rupiah) dan paling banyak Rp10 milyar
(sepuluh milyar rupiah), Undang – Undang Nomor 32 Tahun 1999 Pasal 99 ayat (1)
setiap orang yang karena kelalaiannya mengakibatkan dilampauinya baku mutu
udara ambien, baku mutu air, baku mutu air laut, atau kriteria baku kerusakan
lingkungan hidup dipidanakan dengan pidana penjara paling singkat 1 (satu)
tahun dan paling lama 3 (tiga) tahun dan denda paling sedikit Rp1 milyar (satu
milyar rupiah) dan paling banyak Rp3 milyar (tiga milyar rupiah). Undang –
Undang Nomor 32 Tahun 1999 Pasal 100 ayat (1) setiap orang yang melanggar baku
mutu air limbah, baku mutu emisi, atau baku mutu gangguan dipidana penjara
paling lama 3 (tiga) tahun dan denda paling banyak Rp3 milyar (tiga milyar
rupiah) dan Undang – Undang Nomor 32 Tahun 1999 Pasal 100 ayat (2) tindak pidana
sebagaimana dimaksud pada ayat (1) hanya dapat dikenakan sanksi administratif
yang telah dijatuhkan tidak dipatuhi atau pelanggaran dilakukan lebih dari 1
(satu) kali.
